~N' ORDINANCE TO AMEND THE CODE OF THE CITY OF PORTSMOUTH, VIR- <br />GINIA, 1951, BY ADDING THERETO A NEW SECTION NUMBERED 2-71.9 <br />RELATING TO THE SALE O? LE~CLAIMED PROPERTY IN THE CUSTODY OF <br />POLICE. <br /> <br /> Be it ordained by the Council of the City of Portsmouth, Virginia, that <br />the Code of the City of Portsmouth, Virginia~ 1951, be amended by adding thereto <br />Section 2-71.9 to read as follows: <br /> <br />Section 2-71.9. Sale of Unclaimed ProperTy in the Custody of Police° <br /> <br /> It shall be the duty of the Chief of Police, on the first Monday in June <br />and on the first Monday in December of each and every year~ zo deliver an account, <br />verified by his oath, to the City Manager, of all monies, goods, wares, and mer- <br />chandise then remaining for a period of three months unclaimed in the custody of <br />the Division of Police and immediately thereafter to give notice by advertisement, <br />once a week, for two successive weeks, in some newspaper of general circulation in <br />the City, to all persons interested in or claiming such property that unless claimed <br />by the owner, with satisfactory proof of such ownership, before a specified day, the <br />same will be sold at a place in said notice specified az public auction to the highest <br />bidder, and on the day'and at the place specified in said notice, all such property <br />remaining unclaimed excepz money, shall be sold at auction by the Chief of Police, <br />or under his direction. <br /> <br /> If any goods~ wares, merchandise or chattels which are of perishable nature. <br />or which shall be expensive to keep, shall at any time remain unclaimed in the cus- <br />tody of the Division of Police, it shall be lawful for the Chief of Police to sell <br />the same at public auction, at such time and after such notice as to him shall seem <br />proper, <br /> <br /> The Chief of Police shall, immediately after the sale of property and in <br />accordance herewith, pay to the City Treasurer all money remaining in the custody of <br />the Division of Police, and all monies received by him upon such sale. after deduct- <br />lng the'expenses of the sale. <br /> <br /> Adopted by the Council of the City of Portsmouth at a meeting held on <br />z~ 19600 <br /> <br /> Attest: <br /> <br />City Clerk <br /> <br /> <br />
