AN ORDINANCE TO AN~END ARTICLE III OF CHAPTER 26 OF THE CODE OF <br />THE CITY OF PORTSMOUTH, VIRGINIA, 1951, CONSISTING OF SECTIONS <br />26-36, 26-37, 26-38 AND 26-40, AS ANfENDED, BY ADOPTING IN LIEU <br />THEREOF A NE~ARTiCLE III CONSISTING OF SECTIONS 26-36 T~IROUGH <br />26-41, INCLUSIVE, ESTABLISHING BUILDING SETBACK LINES ON STREETS <br />THEREIN NA~MED. <br /> <br /> Be it ordained by the Council of the City of Portsmouth, VirEinia, that <br />Article III of Chapter 26 of the Code of the City of Portsmouth, Virginia, 1951, <br />consisting of Sections 26-26, 26-3?, 26-38 and 26-40, as amended, be amended <br />and reordained by adopting in lieu thereof a new Article III consistin¢ of <br />Sections 26-36 through 25-41~ inclusive, to read as follows: <br /> <br />ARTICLE III. Building Setback Lines <br /> <br />Section 26-36. Setback lines in general. <br /> <br /> It shall be unlawful for any person to enlarge, exte~d~ or build any <br />porch, bay window extension, shed or other building or s~ructure DH any of the <br />land abutting on the streets set out in the following sections of this Article <br />within the buildin~ setback lines herein prescribed for any such street~ Such <br />building setback line shall apply equally %o botlh sides of such streets unless <br />the contrary intention is stated The purpose and intention of this Article <br />is to facilitate the acquisition of the land required re widen such $~reets to <br />the uniform width indica~edo <br /> <br /> It shall be unlawful for the Building Official or other officials of the <br />city to issue any building permit for any enlarg~en~, extension or construction <br />of any szructure %~thin the prescribed building setback lines of such streets: <br /> <br /> Section 26-37. Street to be sixty feet in width~ <br /> <br /> A buiidinE setback line of ~ · ~ ~ of <br /> ~hlr~y feet from the center <br />ina street is hereby established: <br /> <br />the follo~- <br /> <br />(a) Deep Creak Boulevard, from Jefferson Stree~ to Paradise <br />Creek o <br /> <br /> Section 26-38. Streets to be eighty feet in width. <br /> <br /> A building setback line of forty ~ ~+ <br />ina streets is hereby established: ~e~ from the c~]ter line of the follow- <br /> <br /> (a) Air Line ~rnpike, from Sixth Avenue ~o Alexander's Corne~, <br /> <br /> (b) Clifford Street from Aid!ins Boulevard to ~ins Creek. <br /> <br /> <br />
