AN ORDINANCE TO AN~END ARTICLE III OF CHAPTER 26 OF THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA, 1951, CONSISTING OF SECTIONS 26-36, 26-37, 26-38 AND 26-40, AS ANfENDED, BY ADOPTING IN LIEU THEREOF A NE~ARTiCLE III CONSISTING OF SECTIONS 26-36 T~IROUGH 26-41, INCLUSIVE, ESTABLISHING BUILDING SETBACK LINES ON STREETS THEREIN NA~MED. Be it ordained by the Council of the City of Portsmouth, VirEinia, that Article III of Chapter 26 of the Code of the City of Portsmouth, Virginia, 1951, consisting of Sections 26-26, 26-3?, 26-38 and 26-40, as amended, be amended and reordained by adopting in lieu thereof a new Article III consistin¢ of Sections 26-36 through 25-41~ inclusive, to read as follows: ARTICLE III. Building Setback Lines Section 26-36. Setback lines in general. It shall be unlawful for any person to enlarge, exte~d~ or build any porch, bay window extension, shed or other building or s~ructure DH any of the land abutting on the streets set out in the following sections of this Article within the buildin~ setback lines herein prescribed for any such street~ Such building setback line shall apply equally %o botlh sides of such streets unless the contrary intention is stated The purpose and intention of this Article is to facilitate the acquisition of the land required re widen such $~reets to the uniform width indica~edo It shall be unlawful for the Building Official or other officials of the city to issue any building permit for any enlarg~en~, extension or construction of any szructure %~thin the prescribed building setback lines of such streets: Section 26-37. Street to be sixty feet in width~ A buiidinE setback line of ~ · ~ ~ of ~hlr~y feet from the center ina street is hereby established: the follo~- (a) Deep Creak Boulevard, from Jefferson Stree~ to Paradise Creek o Section 26-38. Streets to be eighty feet in width. A building setback line of forty ~ ~+ ina streets is hereby established: ~e~ from the c~]ter line of the follow- (a) Air Line ~rnpike, from Sixth Avenue ~o Alexander's Corne~, (b) Clifford Street from Aid!ins Boulevard to ~ins Creek.
