~nN OP~DINANCE TO .~5~tEND AND REORDAIN SECTION 2D OF T~{E ~'ORDINANCE <br />TO PROVIDE A SUPPLEMENTAL RETIRE~F~NT SYSTEM FOR CITY k~PLOYEESTM, <br />ADOPTED AUGUST 25~ 195S, AS ASCENDED, IN ORDER TO PROVIDE CONTINUED <br />MEN~ERSNIP FOR LI~ITED PURPOSES FOR CERTAIN E~{PLOYEES TRANSFERRED <br />TO THE OFFICES OF T~E CON3~ISSIONER OF THE REVENUE AND THE CITY <br />TRFASURER~ AND FOR E~PLOYEES OF ~-.~E DEPART~5~NT OF PUBLIC I~EALTH <br />TP~NSF~RED TO THE STATE HFAL~H DEPARTSCENT, <br /> <br />..... Be-it 6rdained by the council of the City of Portsmouth, Virginia, <br /> Section 2Oof ~he "Ordinance to Provide a Supplemental Retiremen~ System for <br /> City ~nployees", adopted August 25~ 1§53~ as amended, be amended and reordained <br /> to read as follows: <br /> <br /> Section 20° CESSATION OF ~E~BERSHIP~ ~ne membership of any person in <br />the system shall cease: <br /> <br /> (a) if he ceases to be an employee, unless the member leaves service <br />after twenty or more years of creditable service and has attained age fifty, and <br />does not withdraw his accumulated contributions, or <br /> <br />(b) in any event upon the withdrawal of his accumulated contributions, or <br /> <br />(c) upon death, <br /> <br /> .~uything to the contrary herein notwithstanding, the membership of any <br />person shall not cease by virtue of the fact that he became eligible for member- <br />ship in the Virginia Retirement System upon employment by or transfer ~o the <br />offices of the Co~missioner of the Revenue or the City Treasurer upon or %ithin <br />sixty days of July l, 1959. The membership of any such ~erson shall cease if <br />his employment in the offices of the Commissioner of the Revenue or the City <br />Treasurer thereafter te~]inates for any reason other than death, retirement or <br />resignation to accept immediate employment with the City in a position covered <br />by the provisions of this ordinance, Service in said offices by any such person <br />sD~ll be considered as creditable service under this ordinance when determining <br />eligibility for ordinary disability retirement, service connected disability re- <br />tirement, and additional death benefits under Sections 38 and 39 hereof~ but such <br />service shall not be considered as creditable service when computing allowances <br />under this ordinance. <br /> <br /> Anything to the contrary herein notwithstanding, the membership of any <br />person shall ao~ cease by virtue of the fact tha~ he became eligible for member- <br />ship in the Virginia Retirement System upon transfer of the DeDarzment of Public <br />Health of the City of Portsmouth to the State Health Department effective July l, <br />1980~ The membership of any such person shall cease if his employment in the <br />State Health Department thereafter terminates for any reason other than death, <br />retirement or resignation ~o accept imme~iate employment with the City in a Dosi- <br />tion covered by the provisions of this ordinance, Service with the State Health <br />Department by any such person shall he considered as creditable service under this <br />ordinance ~nen determining eligibility for ordinary disability ~etirement, ser- <br />vice connscted disability retirement, and additional death benefits under Sec- <br />tions S8 a~ud SS hereof, but such service shall not be considered as creditable <br /> <br /> <br />
