AN ORDINANCE TO AMEND THE CODE OF THE CITY OF PORTSMOUTH, VIR- <br />GINIA, 1951, BY ADDING THERETO A NEW SECTION TO BE NUMBERED <br />17-46ol, PRC~IBITING THE USE OF CERTAIN STREETS AND SIDEWALKS <br />FOR SOLICITING SUBSCRIPTIONS, SELLING GOODS OR SERVICES, OR DIS- <br />TRIBUTING PRINTED ~TTER. <br /> <br /> Be it ordained by the Council of the City of Portsmouth, Virginia, that <br />the Code of the City of Portsmouth, Virginia, 1951, be amended by adding <br />thereto a new section to be numbered l?-4g.1, to read as follows: <br /> <br />Section 17-4g.1. <br /> <br />Soliciting subscriptions, selling goods or <br />services, or distributiDg printed matter <br />on certain streets and sidewalks~ <br /> <br /> (a) No person shall sell or offer to sell any goods, <br />wares, merchandise, books, magazines or any article of value~ except newspapers, <br />or take orders for or sell subscriptions to same for future delivery, or render <br />or offer to render any services ether than the shining of shoes, or distribute <br />printed matter on any of the streets and sidewalks paralleling streets which <br />are (i) designated as parking meter sones in Section 30-145 hereof or (ii) with- <br />in Fire District No. 1 and Fire District No. 2 as set forth in Section 5-3 here- <br />of; said streets and sidewalks being congested areas for pedestrian trivet and <br /> <br /> (b) The prohibition against the sale o~ distribution <br />of the articles mentioned in the first subsection of {his section shall not <br />be construed as prohibiting ~he actual distribution or circulation, without <br />any charge therefor, to the public, of publications~ leaflets, pamphlets or <br />any printed or written matter that disseminates opinion or information or pro- <br />vokes thought or pertains to any religious information or belief° <br /> <br /> (c) Any person violating the provisions of this sec- <br />tion shall be punished by a fine of not less than twenty-five dollars nor more <br />than one hundred dollars, or by confinement in jail for not exceeding thirty <br />days, or both. <br /> <br /> This ordinance being necessary for the preservation o4 the public health, <br />morals and safety, an emergency is declared to exist and it shall take effect <br />from its passage. <br /> <br />Adopted at a meeting of City Council on April 28 , 19gO. <br /> <br />Teste: <br /> <br />City Clerk <br /> <br /> <br />
