AN ORDINANCE TO AUTHOriZE AND DIRECT THE C0)UJEYANCE OF <br />FIVE PARCELS OF LAAVD WITHIN THE PROPOSED RIGHT OF <br />OF THE ACCESS ROAD LEADING TO THE SECOND EL~2J~BETH RIVER <br />T~ TO THE ELIZAB~'£H RIVER TUNNEL DISTRICT <br /> <br /> WHEREAS, the Elizabeth River T~nnet District has been authorized <br />by the General Assembly of Virginia to construct and operate a second vehic- <br />ular ~unnel under the Elizabeth River, and s~ch p~oject includes the construc- <br />tion and operation, among other things, at the expense of the District, of <br />an access road from the Portsmouth portal of the tunnel to the central are~ <br />of Portsmouth; and <br /> <br /> WHEREAS, the Planning Commission h~e recor~mended the convsyance <br />mo the Elizabeth River Tunnel District of five parcels of vacant land now <br />owned By the City, which are within the proposed right of way of the said <br />access road; amd <br /> <br /> WHEREAS~ the Elizabeth River Tunnel District, a political sub- <br />division of the Commonwealth of ¥i~inia with the power of eminent domain, <br />has offered the sums hereinafter stated for the respective parcels of tan~, <br />which sums are considered To be the approximate fai~ market value thereof. <br /> <br /> NOW, THEREFORE, Be it ordained Dy the Co,moil of the Cit~ OT <br />Portsmouth, Virginia, ~hat the M~yo~, amd City Clerk be, ~nd they here~)y are, <br />directed and authorized to execute, seal and deliver to the Elizabeth River <br />Tunnel District, ~pon N~yment of the s~me herinafter stated into the Oity <br />~ a deed in form approved by the City Atto~%ey, with-appropriate <br />warranties of title, conveying the followin~ described five parcels of land <br />situate in the Ci~y of Portsmoulh: <br /> <br />Parcel I. <br /> <br />Lot 27~, south side of Carolina Avenue, for the sum <br />of $350.00. <br /> <br />Parcel 2. <br /> <br />Lots 238, 239. 240, ~41, 242, 243 and 244, north si~e <br />of Southern Avenue, for the sum of $1,750,00. <br /> <br />Parcel <br /> <br />A triangular shaped area of land at the southern tip <br />of the sewerage disposal plant site at Pinners Point, <br />containing approximately 3~840 square feet, and a <br />temporary construction easement adjacent thereto, both <br />of which ar~ shown on the Plat of survey dated April <br />I9~1, prepared by Langley and McDoIzatd, for the <br />$500.0G~ plae~the actual Cost to the City of removing <br />its chain tin~ fence from said land, it being agreed that <br />the Elizabeth River Tunnel District will, at its expense, <br />place and maintain ~ chain link fence along the res~lting <br /> <br /> <br />
