AN OPJ)IN;~%~ TO PEP~MiT THE ENCROA~NT OF TRINITY <br />EPISCOPAL CHURCH UPON THE SIDEWALK OF THE WEST SIDE <br />OF COURT STREET, AT ITS INTERSECTION WITH HIGH STREET <br /> <br /> WHEREAS, the vestibule and steps of Trinity Episco~t C~nurch, <br />as now situated~ encroach upon the sidewalk of Court Street approximately <br />five feet; and <br /> <br /> WHEREAS, surveys and plans prepared in connection with renovation <br />of this historic landmark disclose that the said vestibule and steps must <br />be reconstructed so as to encroach upon the sidewalk of Court Street approx- <br />imately 5.75 feet; <br /> <br /> WHEREAS, the aforesaid encroachment upon Court Street is so slight <br />as not to prevent full enjoyment a~.d use of Court Street by the public or <br />the owner of any property thereon. <br /> <br /> NOW THEREFORE, BE IT ORDAINED by the Council of the City of <br />Portsmouth, Virginia, that rne consent of the City of Portsmouth, Virginia, <br />is hereby ex~ended To the Vestry of Trinity Episcopal Church, situate a~ <br />the southwest corner of High and Court Streets, to continue the existinE <br />and proposed encroachment above described of said Church building upon <br />Court Stree~ for and durin~ the life of said Church building; provided the <br />owners of said building shall acquire no rights in or to the area encroached <br />upon, as against the City of PorTsmouth° <br /> <br /> Adopted by the Council of the City of Portsmouth, Virginia at a <br />meeting held April llth, 1961. <br /> <br />Teste: <br /> <br />City Clerk <br /> <br /> <br />
