ORDINANCE REQL~ESTING THAT THE GENERAL ASSE~iB~L¥ A~D C~P~ IV <br />~ ~ XII ~ ~E C~RT~ OF ~E CI~ ~ POR~O~, BY ~ <br />ING ~IN S~TI~S ~E~OF ~ ADDING C~TAIN N~ S~TI~S ~E~- <br /> IN ~E ~ ~E~IN DE~RIB~. <br /> <br /> WHEREAS~ Sections 15-65.3 and 15-77.74 of the Code of Virginia, 1950, <br />as amended, provide for amendment of city charters upon the holding of a pub- <br />lic hearing and request of the City Council to the General Assembly; and <br /> <br /> WHEREAS~ the City Council is of the opinion that certain amendmen ts <br />to the Charter of the City of Portsmouth are necessary and desirable at this <br />time~ and has held the public hearing specified in the above-mentioned code <br />sections. <br /> <br /> NOW, THEREFORE~ BE IT ORDAINED by the Council of the City of Portsmouth <br />Virginia, that: <br /> <br /> Section 10 ~ae City Attorney is hereby directed to prepare, and the <br />City ~ana~er to transmit to the General Assembly, together with certified copies <br />of this ordinance, drafts of bills ~mending the hereinafter mentioned sections <br />of, and adding new sections to, the Charter of the City of Portsmouth so that <br />said amended sections and new sections shall read as follows: <br /> <br />(Amendment.) <br /> <br />Chapter IV, Section 33. Property assessments. <br /> <br /> (a) All real estate and personal property within the city of Portsmouth <br />shall be assessed for taxation in accordance with the provisions of the general <br />laws of the State~ except as hereafter provided in subsection (b) hereof. <br /> <br /> (b) (1) The co~mcil may, in lieu of the method now prescribed by law. <br />provide for the annual assessment of real estate for taxation. To that end it <br />may appoint a single assessor of real estate to assess such real estate for <br />taxation~ may prescribe the duties and term of office of such assessor, may re- <br />quire that he give his entire time to the duties of his office, may remove him <br />for cause~ may fix his compensation~ which shall be payable out of the treasury <br />of the city~ and may provide for such technical and clerical assistance as may <br />be necessary or advisable and for the payment of any other expenses that may be <br />properly incident thereto. The annual assessments shall be completed by the <br />assessor by the thirty-first day of August of the year in which they are made. <br /> (2) All such real estate shall be assessed at its fair market value <br />and the t~xes for each year on such real estate shall be extended on the bm sis <br />of the last assessment made prior to such year, subject to such changes as may <br />have been lawfully made. <br /> (3) The council may provide that all duties now devolved upon the <br />commissioner of the revenue of the city with respect to the assessment of real <br />estate shall be transferred to and devolve upon the assessor appointed pursuant <br />to this subse~tion~ and the assessor shall pre,are the land books and extend <br /> <br /> <br />
