~afq ORDINKNCE TO AUTHORIZE &ND DIRECT <br />CON~m~Y~NCE OF FOUR PARCELS OF LP~D WITHIN <br />THE PROPOSED RIGHT OF WAY OF INTERSTATE <br />ROUTE 264. <br /> <br /> WHEREAS, the State Highway Department has commenced authorized acquisition of <br />the right of way for Interstate Route 264; and <br /> <br /> WHEREAS~ the Planning Commission approved the location of said highway at the <br />points involving the four parcels of land hereinafter mentioned; and <br /> <br /> 'FrlEREAS, the Commonwealth of Virginias with the power of eminent domain, has <br />offered the sum hereinafter stated for the said parcels of land. <br /> <br /> NOW, THEREFORE, Be it ordained by the Council of the City of Portsmouth~ <br />Virginia: that the Mayor and City Clerk be, and they hereby are, directed and <br />authorized to execute, seal and deliver to the Commonwealth of Virginia, upon <br />pa~nnent of the sum hereinafter stated into the City Treasury, a deed in form <br />approved by the City Attorney, with appropriate warranties of title, conveying the <br />following described four parcels of land situate in the City of Portsmouth: <br /> <br />PARCEL A <br /> <br />Being as sho~m on sheet 52 of the plans to be used for Route <br />264~ State Highway Project 0264~124-071~ R/W 201, and lying <br />on both sides of and adjacent to the proposed Centerline of <br />P~mp 'A" of proposed Route 264 from the lands of Eugene Thomas <br />and Gladys O. Thomas at approximate Station 22+56 (Ramp <br />to the south right of way line of the Seaboard Air Line Railroad <br />at approximate Station 23+54~14; <br /> <br />Following is a metes and bounds description: <br /> <br />Being that certain piece or parcel of land, situated in the City <br />of Portsmouth, Virginia, and bounded and described as follows: <br />Beginning at a point in the southeastern r~ght of way line of <br />the Seaboard Air Line Railroad and the sou~h right of way line of <br />Frederick Boulevard, said point being on an arc of a curve whose <br />radius is 872.22~, thence southeastwardly from said ooint t28.99~ <br />to a point on the lands of Eugene and Gtadys Thomasl thence S <br />78'28~St" w~ a distance of 56~11' to a point; thence northwesterly <br />along the arc of a curve whose radius is S05.91~, a distance of <br />90.22~ to a point; thence N 56°56~44' E 3.38' to the point of <br />beginn.ing~ and containing 0.04S acre~ more or less: RESERVING, <br />however, unto the City of Portsmouth, its successors and assign~ <br />the free and perpetual right, easement mhd privilege to maintain, <br />operate, repair and replace the 20 inch water main crossing said <br />parcel of I~nd, as show~ on said plans. <br /> <br /> <br />
