AN ORDINA~NCE TO PROVIDE FOR THE ACQUISITION OF CERTAIN PROPERTY BY THE CITY OF PORTSMOUTH UNDER EMINENT DO~IN PROCEEDINGS PURSUANT TO CHAPTER 298 OF THE ACTS OF ASSEmbLY OF 1958t SAID PROPERTY BEING NECESSARY FOR IMPROVEMEN~ OF A PORTION'OF PORTSMOUT~ BOULEVARD~ ROUTE 337, PARCEL 052. ~EREAS~ the City of Portsmouth has found it to be necessary to widen and otherwise improve a portion ol Portsmouth Boulevard, Route 337, under a Federal Urban Aid Pro~ram whereOy it ls the responsibility of the said City to acquire all necessary additional property; and WHEREAS, the City of Portsmouth has not been able to purchase certain property necessary to th~s project because certain of the owners~thereoi cannot be ~ound within this state; ~nd reasonably possible. ~EREAS. advancement of the work will be delayed un- if the said property zs not made available as soon as NOW~ T~EREFORE, De it ordained by the Council of the City o£ Portsmouth, Virginia, that the City Attorney is directed no institute eminent domain proceedings, employing counsel for that purpose, against the property hereinafter describedt zn accordance with and pursuant to Section 23-f of the Charter of the City of Portsmouth Cdhspter 258 of the Acts Of Assembly of 1958)~ and that the s~dm of $304.38 be deposited to the credit of the courn, as provided by law to compensate the owners thereo~: The owners of record are as follows: Charlie J. Powell,~M~oel P. Davis, ~Marie P. Ashworth, Dorothy P. Stallings, Jean P. Daley, Melvin Ray Powell, Kathteen Powell, Joyce Ann Powell Hogmire, Lois Powell Collingsworth, Betty Powell Gore, Nlt~ Powell Broda~ and Lillian Powell Stevens. (o) The interest to be acquired is the fee slmpte estate in and to the properny hereinafter described. (c) The approximate area is 1~775 square feet.
