AN O~!NANCE TO PROVIDE FOR THE ACQUISITION OF CERTAIN <br />PROPERTY BY THE CiTY OF PORTSMOUTH ~DER EMINENT DO~2%iN <br />PROCEEDINGS PURSUANT TO CPLAPTER 258 OF THE ACTS OF <br />ASSEH3LY OF 1958, SAiD PROPERTY BEING NECESSARY FOR <br />iMPROVEMENT OF A PORTION OF PORTSMOUTH BOULEVARD, <br />ROUTE 331, PARCEL l?2X. <br /> <br /> ~EREAS, the City of Portsmouth has found it to be <br />necessary to widen and otherwise improve a portion of Portsmouth <br />~oulevard Route 337. under a Federal Urban Aid Program whereby <br />i~ is the responsibility of the said City ~o acquire all necessary <br />additional property; and <br /> <br /> WPiEREAS the City of Portsmouth has not been able <br />purchase certain properny necessary 5o this pro~ec~ oecause the <br />owners thereof are toe able Lo make ~ voluntary conveyance thereof <br />for the reason that the owner of the fee simple es%aee <br />lent; and <br /> <br /> ~,FREREAS advancement Df the work will be de!a'~ed un- <br />reasonably if the said property is not made available as soon as <br />eossible. <br /> <br /> NOW, THEREFORE~ be it ordained by the Council of the <br />City oi Portsmomth Virginia, that the City Attorney is directed <br />~o institute eminenn domain proceedings, employing counsel for <br />tkat purpose ageins5 the property hereinafter described in <br />accordance with and pursuant to Section 23-f of the Charter of <br />the City ol Portsmouth {Chapter 258 of the Acts of Assembly of <br />1958) and that the sum of S1.195.00 De deposited to the credit <br />of the courm as provided by ~aw no compensate the owners thereof: <br /> <br />The owners of record are as follows: <br />Edna J. Carroll~ life ~enant and Patrmcma Rose <br />Carroll remainderman. <br />The interest to be acquired ms a demolition <br />easement described as the rm~nt to enter upon <br />the hereinbetow described parcel of land for e <br />period nom to exceed two years from the date of <br />taking for the purpcse of demolishing and <br />removing therefrom the building concrete apron <br />and other mamerlals situate thereon and on Rdjacent <br />property heretofore acquired by the City of <br />Portsmouth from the aforesaid owners. <br /> <br /> <br />
