AN O~!NANCE TO PROVIDE FOR THE ACQUISITION OF CERTAIN PROPERTY BY THE CiTY OF PORTSMOUTH ~DER EMINENT DO~2%iN PROCEEDINGS PURSUANT TO CPLAPTER 258 OF THE ACTS OF ASSEH3LY OF 1958, SAiD PROPERTY BEING NECESSARY FOR iMPROVEMENT OF A PORTION OF PORTSMOUTH BOULEVARD, ROUTE 331, PARCEL l?2X. ~EREAS, the City of Portsmouth has found it to be necessary to widen and otherwise improve a portion of Portsmouth ~oulevard Route 337. under a Federal Urban Aid Program whereby i~ is the responsibility of the said City ~o acquire all necessary additional property; and WPiEREAS the City of Portsmouth has not been able purchase certain properny necessary 5o this pro~ec~ oecause the owners thereof are toe able Lo make ~ voluntary conveyance thereof for the reason that the owner of the fee simple es%aee lent; and ~,FREREAS advancement Df the work will be de!a'~ed un- reasonably if the said property is not made available as soon as eossible. NOW, THEREFORE~ be it ordained by the Council of the City oi Portsmomth Virginia, that the City Attorney is directed ~o institute eminenn domain proceedings, employing counsel for tkat purpose ageins5 the property hereinafter described in accordance with and pursuant to Section 23-f of the Charter of the City ol Portsmouth {Chapter 258 of the Acts of Assembly of 1958) and that the sum of S1.195.00 De deposited to the credit of the courm as provided by ~aw no compensate the owners thereof: The owners of record are as follows: Edna J. Carroll~ life ~enant and Patrmcma Rose Carroll remainderman. The interest to be acquired ms a demolition easement described as the rm~nt to enter upon the hereinbetow described parcel of land for e period nom to exceed two years from the date of taking for the purpcse of demolishing and removing therefrom the building concrete apron and other mamerlals situate thereon and on Rdjacent property heretofore acquired by the City of Portsmouth from the aforesaid owners.
