AN ORDINANCE TO ~,~END THE CODE OF THE CITY OF <br />PORTSMOUTH, VIRGINIA, 1961, BY REPEALING SECTION <br />3-22 ~{EREOF, PERTAINING TO FAILURE TO PAY <br />STATE DOG LICENSE TAX, AND BY ADDING THERETO TWELVE <br />NEW SECTIONS NUMBERED 3-34, 3-35, 3-36, 3-37, 3-38, <br />3-39, 3-40, 3-41, 3r42, 3-43, 3-44 and 3-45 IMPOSING <br />A CITY LICENSE TAX ON DOCS AND PROVIDING FOR THE <br />APPLICATION, COLLECTION, ISSUANCE OF TAGS, AND <br />RECORDS OF SU~{ TAX, AND PROVIDING PENALTIES. <br /> <br /> WHEREAS, pursuant to Section 29-184,5 of the Code <br />of Virginia, 1950, as amended, the City of Portsmouth <br />has entered into an agreement with the Commonwealth <br />of Virginia, Commission of Game and Inland Fisheries, <br />that the Treasurer of the City of Portsmouth shall <br />not be required to remit any oortion of the gross <br />receipts from the sale of dog licenses to the State <br />Treasurer as required in Section 29-206 of the Code <br />of Virginia, 1950, ss ~unended; and <br /> <br /> Ifl~EREAS, the City of Portsmouth has agreed to <br />assume all the responsibility for the enforcement of <br />the dog laws within the corporate limits of the City <br />of Portsmouth, thereby relieving the Commonwealth <br />of Virginia, Commission of Game and Inland Fisheries <br />from theresponsibility of enforcing the regulations <br />and laws pertaining to dogs as set forth in Chapter 9 <br />of Title 29 of the Code of Virginia, 1950, as amended: <br />and <br /> <br /> WHEREAS, under the provisions contained in Section <br />29-208.1 of the Cdde or. Virginia, 1950, as amended, the <br />City of Portsmouth is permitted to provide a method of <br />obtaining licenses and tags of a type described by <br />ordinance, and that the tax may be the same on all <br />dogs, male, female or unsexed~ <br /> <br /> NOW, ~EREFORE, BE IT ORDAINED by the Council of <br />the City of Portsmouth, Virginia: <br /> <br />Section 1o That section 3-22 of the Code of the City <br />of Portsmouth~ Virginia~ 196!, be and the same hereby <br />is repealed° <br /> <br /> <br />
