~N ORDINANCE TO PRC-JIDE FOR T~E ACQUZSITION OF CE~ PRO~ BY ~ <br />CI~ OF PO~SMO~q ~ER E~.~ ~N PROC~D~GS PL~U~ TO <br />126 OF ~ A~ OF ~SEiYBLY OF 1964, S~D PROP~ BEING ~Y ~R <br />~ CONSTRU~ON OF A S~T~ SEveR ~ P~G ST~ION ~ ~ ~ <br /> <br /> ~ ~fHH~EAS, in cooperation with the Federal and State goverr~v~nts, a <br />new National Guard Armory is being constructed in and for the C~ty of <br />Portsmouth, Virgir~La; smd <br /> <br /> ~fH~ED£, one of the obligations of the City of Portsmouth .~th <br />respect To said building is the propulsion of all utility services, <br />cluding sewerage facilities; and <br /> <br /> :~HEREAS, the City of Portsmouth has found it to be necessary ~o <br />acquire the Luterests hereL~Sk~ter specified, ~u and ~o the hereir~er <br />described parcels of land situave in the City of Portsmouth, Virginia, <br />for the purpose of constructing a sanitary sewer and pumping statio~ to <br />serve the aforesaid National Guard ~mory; and <br /> <br /> ~fHERE~S, the City of Portsmouth has not been able ye put-chase cer- <br />tain property necessary to tbJ~s project because the owners thereof and <br />the City have not been able To agree upon the price to be paid therefor, <br />-or the City bas not been able To ioca~e certain of the owners or because <br />of the status of the title of certain parcels of the property; and <br /> <br /> W]~EREAS, advancement of the work and occupancy of said National <br />Guard Ar~ory will be delayed unreasonably if the said prope~y is not <br />made available as soon as possible. <br /> <br /> NO~, ~HEREFORE, be it ordaLned by the Council of the City of Por~s- <br />mouth, Virginia. <br /> <br />Section 1. The City Attorney is directed to institute eminent <br />domain proceedings, employir~ counsel for that pta~pose, against <br />the property hereinafter described located along Bailard Avenue, <br />for the purpose of acquirLug easements therein, exceot Parcel 25 <br />in which the fee simple title is to be acquired, ~u i~ccordance <br />with mud pursuant to Section 23-f of the Charter of the City of <br />Portsmouth (Chapter 126 of the Acts of Assembly of 1964), .mad <br />deposit to the credit of the court as provided by law the stur.~ <br />specified to cor~per~a~e the respective ovaners of the various <br />parcels of land, as showm on the location plan for Batlard <br />Avenue sewers, prepared by R.
