AN ORDZaNANCE TO ~V~ND SECTION 26-79 OF THE CODE <br />OF ~qi CI~f OF P0~SM~r~2i]-{, ¥IRGI~tA, 1961, TO <br />PROVIDE THAT THE ~[SN/3,~0M OP~INARY DISABILITY <br />RETIRE~aNT AIJ_OWANCE SHALL NOT BE LESS THAN <br />TWENTY PER CENT (20%) OF THE AVERAGE FINAL <br />COMPENSATION. <br /> <br /> Be it ordained by the Council of the City <br />of Portsmouth, Virginia, that Section 26-?9 of <br />the Code of the City of Portsmouth, Vir~jania, <br />1961, be amended and reordained to read ss <br />follows: <br /> <br />Section 26-79. Ordinary disability retirement <br /> a]]owanceo <br /> <br /> (a) Upon retirement as provided, in section <br />26-78, a member shall receive an annual retire- <br />ment allowance payable monthly during his life- <br />time and continued disability of an amount equal <br />to the following: <br /> <br /> (1) If such retirement occurs more <br />than five years and six months prior <br />to normal retirement date, one and one- <br />third per cen~ of his average final cc~- <br />pensation multipled by his number of <br />years of creditable service, not in excess <br />of~ twenty-five. <br /> <br /> (2) If the period from the disa- <br />bility retirement date ~o the normal <br />retiremen~ date is lime years and six <br />months or less, an amount calculated <br />as in (1) except that in place of one <br />and one-third percent there shall be <br />used a percent determined by deduct- <br />ing from two percent the product of <br />(i) 1/100 of one percent and (ii) the <br />nuttier of full months from date of <br />disability retirement ~o normal retire- <br />ment date, <br /> <br /> <br />
