AN ORDINANCE TO PROVIDE FOR ~HE ACQUISITION 0F c~AiN <br />PROPERIT BY THE CITY OF PORTSI~DUIH UNDER EMINENT DOMJYIN <br />PROCEEDINGS PURSU;~T TO CHAPTER 126 OF ~tE ACTS OF <br />ASSERBLY OF 1964, SAID PROPERIT BEING NECESSARY FOR <br />t2~ROVEMENT OF A PORTION OF PORTSMOUTH BOULEVARD, ROUTE <br />337,. PARCEL 145. <br /> <br /> WHE~S, the City of Portsmouth has found it to be necessary to <br />widen and otlner~,;ise improve a portion of Portsmouth Boulevard, Route 337, <br />under a Federal Urban Aid Program ~ereby it is the responsibility of the <br />said City to acquire all necessary additional property; and <br /> <br /> WHEBEAS, the City of Portsmouth has not been able to purchase <br />certain property necessary to this project because the owner t~reof is <br />unable to convey legal title ohereto: <br /> <br /> NOW, THEREFORE, be it ordained by the Council of the City of <br />Portsmouth, Virginia, that the City Attorney is directed to institute <br />eminent domain procee~ngs, employing counsel for that purpose, against the <br />property hereinafter described, in accordance ~ith and pursuant to Section <br />23-f of the Charter of the City of Portsmouth (Chapter 126 of the Acts of <br />Assembty of 1964), and that th~ sUm of $285.00 be deposited to the credit <br />of the cour~ as provided by law to compensate the owner thereof: <br /> <br /> (a) The owners of record are as foll~s: <br /> James T. Copley, Inc., its successor~ and <br /> assigns and its lien creditors. <br />~(b) Tne interest to De acquired is the fee simple <br /> estate in and ~o the propersy hereinafter <br /> described as Parcel 145Z, and a two year <br /> construction easement in and to the property <br /> hereinafter described as Parcel i45Y. <br /> (c) ~le approximate area of Parcel 145Z is 2,590 <br /> square feet, and of Parcel145Y is 4687 square <br /> feet. <br /> (d) The description of the property is as follows: <br /> <br /> Those certain <br /> parcels of land situate in the <br />City of Portsmouth, Virgir~a, mere particularly <br />described as foll~s: <br /> <br />PARCEL i45Z <br /> <br /> That part of Lotu 6, 7 and 8, Block 4, as sho~ on Plat <br />No. 1 of Oregon Fars~, duly recorded in the Clerk's Office <br />of the Circuit Court of the City of Ches~oeake, ~i~gihia, in <br />Map Book 23, psge 83, 'being a strip of land 15 ~eet in width <br />lying between the northern boundar~y of Portsmodth Boulevard <br /> <br /> <br />
