- ORDINAHCE <br /> <br />AN ORDINANCE TO AMEND SECTION 38-5 OF TIlE CODE <br />OF THE CITY OF PORTSHOOTH, VIRG.~NIA~ 1961~ <br />RELATING TO Tile cARRYING '~)F CON~AL~/)~/EAPONS, <br />SO AS TO CONFORM we CHANGES IN THE STATE LAW. <br /> <br /> Be it ordained by the Council of the City <br />of Portsmouth, Virginia, that Section 38-5 of the <br />Code of the City of Portsmouth, Virginia, 1961, <br />be amended and reordained to read as follows: <br /> <br />Sec. $8-5 Carrying concealed weapons - <br /> generally <br /> <br /> If any person carry about his person, hid <br />from common observation, any pistol, dirk, bowie <br />knife, switchblade knife, razor, slungshot, metal <br />knucks, or any weapon of like kind, he shall up- <br />on conviction thereof be fined not less than <br />twenty dollars nor more tllan five hundred dollars <br />and~ in the discretion of the jury or the court <br />trying the case without a jury, may, in addition <br />thereto, be committed to jail for not more than <br />twelve months, and such pistol, dirk, bowie <br />knife, switchblade knife, razor, slungshot, metal <br />knucks, or weapon of like kind, shall, by order <br />of the court be forfeited to the City and may <br />be seized by an officer as forfeited~ and such <br />as may be needed for police officers and con- <br />servators of the peace shall be devoted to that <br />purpose, and the remainder shall be destroyed <br />by the officer having them in charge. <br /> <br /> This .section shall not apply to any police <br />officer, sergeants, sheriffs, officers or guards <br />of the penitentiary or other institutions or <br />camps of the State corrections system conser- <br />vators of the peace other than notaries public, <br />or to carriers of United States mail in the <br />rural districts, or to any collecting officer <br />while in the d~scharge of his official duty. <br /> <br /> Adopted by the Council of the City of Ports- <br />mouth, Virginia, at a meeti~ held May 10, 1966. <br /> <br /> Teste: <br /> <br />City Clerk <br /> <br /> <br />
