ORDINANCE NO.1 - lO <br /> <br />~ ORDINANCE TO LEASE TO TIDEWATER CO~.TJNITY BASEBALL <br />CORPORATION THE PHOPEHTY KNOWN AS FRkNK D. LAWRENCE <br />STADIUM FOR THE TEEM AND UPON THE CONDITIONS AND SUBJECT <br />TO ~HE PROVISIONS HH~EAb'I%R SET FOP~H AS FOLLOWS: <br /> <br />Be it ordained by the Council of the City of Portsmouth, Virginia: <br /> <br />Section 1: The privilege of leasing Frank D. Lawrence Stadium is hereby <br />granted to Tidewater Community Baseball Corporation. <br /> <br />Section 2: Within thirty days of the final passage of this ordinance <br />Tidewater Cc~munity Baseball Corporation shall enter into a lease with <br />the City for the use of Frank D. Lawrence Stadium which said lease <br />shall be substantially in the foltovring form: <br /> <br /> THIS AGRE~fl~T OF LEASE, made this 1st day of January, 1966, <br />between the City of Portsmouth, Virginia, a municipal corporation, here- <br />inafter called "Lessor", mud Tidewater Conmzm~ty Baseball Corporation, <br />hereinafter called "Lessee": <br /> <br /> WITNESSETH: The Lessor, for and in consideration of the rent <br />reserved and the covenants and agreements to be kept and performed by <br />the parties hereto, agrees to let and rent, and does by these presents <br />hereby let and rent, unto the Lessee all that piece or parcel of land <br />situate, lying and being in the City of Portsmouth, Virginia, known as <br />and by the name of Frank D. Lawrence Stadium, including the playing field, <br />electric lighting sysoem, grandstand, bleachers, offices and all fixtures <br />and appurtenances thereto, upon the follo~.~ng ter~z and conditions: <br /> <br /> 1. .The term of this lease shall con~r~nce on the 1st day of <br />Janua~f, 1966, and shall terminate on the 31st day of December, 1966, and <br />the rent payable therefor shall be the sum of One Thousand and no/100 <br />($1,000.00) Dollars, payable on the 1st day of January, 1966, and srmually <br />thereafter for each renewal. <br /> <br /> 2. Lessee shall have the exclusive use of the demised premises <br />during the term provided in paragraph 1 for conducting professicr~l base- <br />bs21 games and for other events as the Lessee might schedule to be held <br />on the demised premises. The Lessee shall also have the exclusive rights <br />upon the Lnside of the temporary fences to be constructed g0~krounding <br />the playing field, and elsewhere upon the demised premises at Such places <br />as the Lessor may agree to in writing, and shall also have all .rights <br />to the sale of concessions and scorecards during any of -~he~ events sched- <br />uled by the Lessee during the term provided in Paragraph 1, subject to <br />existing contracts which the City may have reg~r~ advertising or <br />concessions. <br /> <br /> <br />
