a motor vehicle upon the highways of tlnis state, then reDuses to ~ermit the taking of a sample of ~zis blood for such vesvs, the arrest- ir~s officer shall take the person arresved before a co~nittil%g magistrate, and if he does again so re~ase after hav-i~ been further ad- vised by such magistrate of the law requirir~S a blood test ~o be taken and the penalty for refusal a~d so declares a~ain his refusal in ~.~iting upon a fora provided by the chief medical examiner of the sta~e (hereinafter re- ferred vo as "chief medical examiner") or re- fuses or fails to so declare in ~riting and such fact is certified as prescribed in para- graph (j), then no blood san~p!e siqall be taken even though he may thereafter reques~ same. (d) Only a physician, registered profes- sio~l nurse, g~aduate !aboratomj tec~micimn or a technician or nurse des~g~ted by order of a cour~ of record acting upon the reca~.~en- dation of a !icer~ed physician, usir~ soap auld water to clear, se the par~ of the body fram ' wlaich the blood is ts2~en ~nd usi~ instr~ents sterilized by the accepted steam sterilizer or same other sterilizer wlnich ~,~ill not affect the accu_~acy of the test~ or usi~-~ chanicatly clean sterile dispos~ste syrir~ges~ shall with- draw blood for the purpose of dete~%ihir~ the alcoholic con~ent thereof. No civil liability shall atvach to a~z person authorized to with- draw blood as provided herein as a result of the act of withdrawing blood fran~ ar~ person submittin~ thereto, provided the blood was ~ithdra~.~ accordi_~S to recoghized m~aical procedures; s~ad provided fu_~ther that vne fore- going shall not relieve 8~ny such person fram liability for ne~sligence in the withcirawir~ of any blood sample.
