The~provisions of t~e Building Code, relating to the construction, repair, alteration, erl~gem~t and movin~ of buildings or structures in fire districts shall not apply to buildirgs or structures in a Historic District when the Fire Chief certix~ies to the conmuission that in his opir~on such buildirg or structure ar~ the~ character of construction thereof wqll not materially increase the da~ger frmu fire, and the cmmnission is of the opinion that the construction, alteration, enlargement or movirg the building or structure into or within the district Will accomplish, encourage and prmmote ~he purposes and objectives set ou~ in Section 9-t. (h) Except as otherwise provided i~ this section, ~no~ herein contained shall affect the application of the provisions of the Building Code to buildings or structures in a Historic District. Sec. ~-i2. Historical or architectural value, etc,, to be considered prior to issuance of certificate of appropriateness. Before a certificate of appropriateness is issued bY the ccawnlission, upon conferrirg · with the applicant for the permit for the damolition Of a building or structare, the cc~mission, in addition to other pertinent factors which may be involved in the ex- ecution of the purposes and objectives declared in Sedtion 9-1 shall consider the historical or architectural value and-significance of the building or structure ~ its ~elationship to or congruity with the land, place and area in the Historic District upon which it is e~ected and with other buildirg~s or s~rucvures therein. Sec. 9-13. Factors for refusing, conditioning or modifying, certificate of appropriateness, by conm~issicn. Each certificate of appropriateness sb~]l be issued or refused or conditioned or modified by the cmamission only upon and after consideration of the factors set out in Section 9-8 through .9-12. Sec. 9-14. Issuance of certificate of appropriateness without conditions or mo~ fications in hardship cases. The cmamission may nevertheless issue a certificate of appropriateness, with or with- . out conditions or modifications, for the location, construction, recorztruction, alteration, rep~ or damolition of a building or structure notwithstanding its con- sideration of and dete~tion with respect to-the factors set oat in SeCtions 9-8 through 9-12, ~nen the cmmmission finds that because pf conditions espeCially affecting the buildir~ or structure, but not affecting the historic value, importance or s~nifican of other b~i]dings or structures, land~ places or areas in a Historic District, re~sal to issue the certificate will cause substantial hardship to the applicant, and its issusnce will not result in substantial detri~uent to o~ derogatmon oz the p~urposes and objectives declared in Section 9-1.
