Sec. 9-3. Compliance- ;,rlth article. In order to farther execute the purposes and objectives declared in Section 9-1 and pursuant to the paver granted to and conferred upon the city, the location, construction, reconstruction, alteration, repair and d~uolition Of buildings and other structures or improvaments in Historic ~istric~s shall be subject to and shall be governed and controlled DY- the regu~atior~ and restrictions contained herein; and no building, structure or L~rovement shall he locate~d~, constructed, reconstruct~ed, altered, repaired or damolished in a Historic District unless the location, construction, reconstruction, alteration~ repair or demolition thereof cc~kolies ~th ~]] the regulations established by this article. Sec. 9-4. Cavmission of ~rchitecturai review. (a) In order to furthar execute the purposes and objectives declared in Section 9-1 and pursuant to the power gr~nted to and conferred upon the city, thereiis hereby created and established a commission of architectural review ~nich shall be known as the Cm~uission of Arch~bec~ural Review, and hereinafter ~in this article referred to as "c~uission". (b) The conm~ssion slnall consist of five members~ ~,~o are citizens of the city. They shall be appointed by the City Council for terms of office of five years fram the date of appoin~er~; provided that the te~m of office of ~ue member of the c~aission first appointed shall be for one year, one ~sba]l be for two years, one shall be for three years, one shall loe for four years an~ one shall be for five years, and there- after each mamber shall be appointed for a tern of five years. One of the members of the ccrmmission sh~] ] be appointed from at' least 'three 'nmm~nees made by the Portmmouth & Nmrfo]2~ Cou~£y Bar Association, one shall be~'appointed from~at least three nominees made by Tidewater Section of the-Virginia Chapter of the Dmerican Institute of Architects, one shall be appointed from at least tlmree nominees made by the Portsmouth Historic Association, one shall be appointed from a~ ~least three naminees made by the Portamouth Real Estat~ Board, ~nd one shall be the project a/chitect for the "Old Towne Conservation Project'~ for the duration of the project loan s_nd grant con~rac~ of Urban Renewai Projec~ VA R-49 "Old T0~e";upon termination · of this loan and grant contract this member shall ~e appointed frcm the citizens of the city at l~e. A vacancy occurring in the membership of the cmmmission for any cause shall be filled for the unexpired ~erm by the City Council from nominees made by the organization or association ~_icn originally nominated the m~er causing~~ the vacancy. The members of the cormnission shall serve as such ~rithout compensation. (c) The commission shall elect from its membership a chairman m~d vice-cha~, ~fnose terms of office shall be fixed by the CmmT~ssion. The chaikm~n gnall preside over the meetings of the commission and shall have the same right to vote and speak therein as other members. %ae vice-chairman shall in the absence or disability of the chairman perfom tlne duties of the c.haf~nan. In the absence or disability of both tlne chair~..~n and tlne vice-c~ir~n, the cc~mission s~]] by a majority vo~e of tDose present choose one of their mambers to act as chairman 'prottempore.
