AN ORDINANCE TO A}~]END THE CODE OF THE CITY OF PORTSMOUTH, <br />VIRGINIA, 19617 BY AMENDING SECTIONS 13-18, 13-20, 13-22, <br />AND 13-27 THEREOF AND BY ADDING THERETO A NEW SECTION <br />N~4BERED 1S-21.1, ALL RELATING TO THE SERVICE CNARGES <br />IMPOSED FOR THE COLLECTION AND DISPOSAL OF TRASH AND <br />GARBAGE FROM BUSINESS AND INDUSTRIAL ESTABLIS~4ENTS. <br /> <br /> Be it ordained by the Council of the City of Portsmouth, <br />qirginia: <br /> <br />1. That the Code of the City of Portsmouth, Virginia, 1961, be amended by <br />mmending sections 13-18, 13-20, 15-22, and 13-27 thereof, and by adding <br />thereto a new section numbered 1S-21.!, such amended and new sections to <br />read as follows: <br /> <br />Section 13-18. Definitions. <br /> <br /> For the purposes of this article, the following terms shall <br />have the meaning given herein: <br /> <br /> (a) Business and industrial establishments. "Business <br />and industrial establishments" are premises wherein: <br />(1) There is carried on any business, profession or <br />occupation subject to the license tax ordinance of the <br />city. <br />(2) There ~s carried on any manufacturing or industrial <br />process. <br />(b) Director, "Director" shall mean the director of <br />public works of the ~ity or his authorized representative. <br />(c) Garbage. The term "garbage" shall mean putrescible <br />animal and vegetable wastes resulting from the handling, <br />preparation, cooking and consumption of food. <br />(d) Operator. An "operator" is the person, firm, corpora- <br />tion or association conducting any business or industrial <br />establishment as defined herein, as distinguished frown <br />the owner of the premises involved. <br />(e) Refuse. The term "refuse" shall include all ~utrescible <br />and nonnutrescible solid was*es (except body wastes), <br />including garbage, rubbish,ashes, street cleanings, dead <br />animals and solid market and industrial was~zes. <br /> <br />Section 15-20. Based on standard containers. <br /> <br /> Rates for service charges hereunder shall be based upon the <br />use of standard thirty-two gallon containers or approved dump- <br />master-type containers of two, three, four, six or eigh~ cubic <br />yard capacity or approved dumpster-t>~e conteiners of six, eight <br />or ten cubic yard capacity.
