AN ORDINANCE TO PERMIT ~IHE ENCROACI~,~ OF THE FROFESSIO~L BUTI,~ING ' ' OWNED BY OFFICE BUILDING CORPORATION UPON T~ SIDEYIALK ON THE SOUTH, SIDE OF HIGH STREET AN]D OVER ~HE SIDE~'tAI~ ON THE EAST SIDE OF WASHINGTON I~EREAS, Office B~ilding Corporation owns that certain building kno~rn as the "Professional Building" and is presentiy engaged in renovat- ing said building; and WHEREAS, surveys and plans prepared in connection ~rith said renovation disclose that the building encroaches .45 feet on the side- walk of High Street at the northeast corner of the building and running westerly in a wedge shape~ pattern to about the center of the building and that the cornice or face of the building at the second floor level extends .94 feet over the sidewalk area on ~he east side of Washington Street; and WHERK&S, the aforesaid encroachments upon High Street and Waskington Street are so slight as n6t to prevent full enjoyment and use of said §treets by the public or the ovmer of any property thereon. ~i NOW, THEREFORE, BE IT ORDAiNeD by the Council of the City of Portsmouth, Virginia, that the consent of the City of Portsmouth~ Virgir~a, is hereby extended to Office t~3~lding Corporation to continue the existing encroachments by the Professioral Building upon High Street and Washington Street for mhd during the life of said building; provided however, that the owner of said b~lding shall acquire no rights in or to the areas encroached upon as against the City of Portsmouth and that the permission hereby ~anted shall expire upon the occasion of the said building being removed or destroyed.
