~\T ORDIN~d~CE ~O~T~G A ~T BUIiDL~G CODE FOR I~HE CITer OF PORT~0b~E~ ~£4iCH PRESCP~BES PF~WALT ~S FOR Vt0L~TION OF IT'S PROVISIONS~ ;~) REPEALiAWG~ WT[TH CER_~AIN L~ITATIONS A~ EXCEP~IONS~ ALL OP~IN~NCES ~\~ P~TS OF ORD~M~2~CES OF A Q~ Nf~F~ IN C0?~ICT WII~H T~ PRO?TS!ONS Be it or~dained by the Co-~nsil of the City of Portsmouth: Section 1: That all amd sir~ulsa~ the provisions relati~ to the cor~str~ction~ equip~nt~ alteration~ repair, removal s~nd damolition of buil~lr~s ~nd structures in the City of ~or~smouth ~nd fees therefor ~nd penalties for violations, set forth in the chapters ~and sections of the new bui!di~g code for the City of Portsmouth~ a copy of which is at- tached hereto~ be ~nd the s~me are hereby ordained as general ordim~nces of the City of Portsmouth ~ad are hereby adopted as s~ shall constituve the~ "Building Code of the City of Portsmouth~ 1970:~. Sectiom 2: ~at the provisions of said building code shall be in force on and after January 1~ 1970. Section 3: That all ordinances and psrts of ordine~mes of a general hat,me ~a 'corflict with the provisions of said buildimg code are hereby repealed as of J~nuary 1~ 1970~ but said repes_l~ however~ shall not affect ~ny a¢~6 or offense done or com,_mitted~ or any per~ity~ for- feiture or pumisY~nent incurred~ or s~y right accr~.ing or accrmed~ or acquired· or established before the day upon which the provisions of said building code ts_kc effect~ or Shy prosecution~ suit or pro¢'eed- in~ pending on that day. Section 4: ~nat noth~ ~n said building code contained shall require ~6~ change in the p!ans~ 6onstruction~ alteration or repair of amjf build~m~ or str~cture for ~gnich a permit had. been ~8mted or for 'whicl~ plans were on file with the Deps~¢ment of ~s_ilding I~spection prior to J&nuav~ 1~ 1970~ e~nd the construction~ alteration or repair of which b~2ildir~ or svrust~me frmm such p!s~ns shall have been star, ed ~tkin ninety da~ys frmm said Je-n~rty i, 1970~ provided~ however, that if the constr~stion~ alteration or repair of any such building or strmcture shall be ~iseontinued for a period of r~nety days after said building code takes effect ~ any ~%mther cor~trucvion~ alteration or repair of such buildir~ or structure shark1 be in confor~_ity with the provisions of said building code.
