AN ORDINANCE TO AM~D THE CODE OF THE CITY OF PORTSMOUTH, VIRGI~Y/A, 1961, 'BY 'AMENDING SECTIONS 34-4, 34-28~ ~4-36, 34-45,-34-48, 34~52, ~%D 34-56, PERTAINING TO THE OPERATION OF TAXICABS AND THE LICENSING OF DRIVERS THEREOF, AND BY REPEALING SECTION 34-53, PERTAINING TOTHE ISSUANCE OF BADGES. Be it ordained by the Council of the City of Portsmouth, Virginia: I. That sections 34-4, 34-28, 34-36, 34-45, 34-48, 34-52, and 34-56 of the Code of the City of Portsmouth, Virginia, 1961, be amended and reordained to read as follows: Section 34-4. Stands and Parking Places. The city manager shall designate the stands or parkirg places for taxicabs and shall assign spaces to the operator thereof. At least two taxicab parking spaces shall be designated in that por- tion of the city lying north of the Western Branch of the Elizabeth River; the operator or operators to whom these spaces are assigned shall operate at least two taxicabs in the aforesaid portion of the city from the spaces assigned. It shall be unlawful for any owner or operator to park at any place or to use any stand other than that so assigned. It shall be unlawful for any vehicle other than regularly assigned taxicabs to park in such designated areas assigned to taxicabs. Section 34-28. Limitation on N~mber of Passengers Carrie~;. Passer, ers in Front Seat. Mo taxicab shall be used to transport more than five pas- sengers, This limitation shall not apply to '~mall children. Section 34-36. Limit on N~er Issued. The number of taxicabs to be authorized and for which cer- tificates of public convenience ~nd necessity may be g~anted, shall be as follows: Not more than sixty-two taxicabs, except in cases of emer- gency and on special occasions when convenience and necessity require~ the holder of a certificate operating a fleet of taxicabs who operates duly licensed taxicabs in other cities may bring into the city during the emergency taxicabs from such other city when authorized so to do by the city manager.
