Section 26-31. Service retirement. <br /> <br /> (a) Normal retirement: Any member in service at his normal retirement date <br />may retire at any time then or .thereafter up.on written notification to the board, <br />made by such member or his appointing authority, settinE forth at what time the <br />retirement is to become effective; provided, that such effective date shall be <br />after his last dayof service, but shall not be more than ninety days prior to or <br />subsequent to the filing of such notice. <br /> <br /> (b) Early retirement: Any member who is in service on or after his sixtieth <br />birthday may retire upon ~itten notification to the board, made by the ~mber or <br />his employer, setting forth at what time the retirement is to become effective; <br />provided, that such effective date shall be after his last day of service and after <br />the filing of such notice but shall not be more than ninety days subsequent to the <br />filing of such notice. <br /> <br /> (c) Deferred retirement for members terminating service: Any member having <br />left the service after the attainment of age fifty and after,having completed twenty <br />years of creditable service, may retire under the provisions of subsection (a) of <br />this section, or under the provisions of subsection (b) of this section except that <br />any requirements as to the member being in service shall not apply. <br /> <br /> (d) Mandatory retirement: ~ny member remaining in service after his normal <br />retirement date who attains the maximum retirement age shall be retired forthvrith. <br /> <br />Section 26-37. Refund of Accumulated Contributions. <br /> <br /> " (a) Upon the retirement or termination of service of a member after June 30, <br />1967~ other than by death, he shall be paid, on demand but not later then ninety <br />days thereafter, the amount of his accumulate~ contributions, if any, in a lump sum; <br />provided that if the amount of the member's accumulated contributions is less than <br />ten dollars, no such payment sh~.ll be made. Any member as of July 1,.1967, whose <br />ser~ce ter~minated prior to such date, ar~whohas not withdra~nhi~ accumulated <br />contributions, and ~o is en,mtled to future bene~mto under subsection (c) of <br />Section 26-31 , may elec.t at.any time prior to retirement to receive a payment <br />of his accumulated contrmbutmo~n~, bdt anysuch payment shall terrmtnate b~s member- <br />ship and his rmghts to-any further benefits hereunder. <br /> <br /> (b) Should a member die at any time before retirement, the amount of his <br />accumulated contributions shall then be payable in a ltm~ s~a in accordance with <br />Section 26-42; provided that if the a~unt of the members ycc~raulated contributions <br />is less t~n ten dollars, no such pa)~aent shall be made. <br /> <br />Section 26-48. Definitions. <br /> <br /> As used in this article, unless otherwise required by the context, the fotlo~ <br />lng wSrds and terms shall have the meanir~ indicated: <br /> <br /> Accumulated contributions. ~ne term "accumulated contributions" shall be <br />taken to mea~ the sum of all amounts deducted from the compensation of a member <br />as contributions to the system, together ~th interest thereon at the rate of two <br /> <br /> <br />
