AN ORDnanCE TO ~2'~-~D T~ ZONING ORDINANCE OF THE CITY OF <br />PORTS~,~UTH, 1961, BY ~DING SECTION 4-2 THEREOF, PER- <br />TAINTinG TO THE PRCCEDURE FOR SECURING USE PE~[TS. <br /> <br /> Be it ordained by the Council of the City of Portsmouth, Virginia, <br />that the Zoning Ordinance of the City of Portsmouth, 1961, be amended by <br />amending Section 4-2 thereof, such amended section to read as follows: <br /> <br />Section 4-2. Use Permits. <br /> <br /> Use permits when required shall be secured from the City Council <br />in the following manner and upon the following conditions: <br /> <br /> (a) Application for a use permit shall be made in v~iting to the <br />Planning Director, by the prospective occupant, and acknowledged by the own- <br />er of the property, acco~,~ed by a receipt s.hov~hng payment to the City <br />Treasurer of a fee of fifty dollars, to cover the cost of reviewing and <br />processing the application. <br /> <br /> (b) The posting of signs, publishing of legal notices and other <br />procedures with respect to petitions foramen~ments of this ordinance as <br />provided in Sections 8-4, 8-5, and 8-6, shall be &oserved and followed. <br /> <br /> (c) When transmitting any such application to the ~City Council, the <br />Plarm~ngDirector shall append thereto reports and comments of mny interested <br />depart=ent head, including without limitation the Chief of the Divisiom of <br />Fire, the Director of Public Health m~ the Director of Public Works. <br /> <br /> (d) If the City Co~mncil shall find that the use for which a use <br />permit is sought (1) will not adversely affect the health or safety of per- <br />sons residing or working in the neighborhood of the proposed use, (2) will <br />not be detrimental to the public welfare or injurious to property or imorove- <br />ments in the neighborhood, mud (3) will be in accord with the ptarposes ~f t~his <br />ordinance, it shall issue the use permit provided that all other provisions <br />of law and ordinance shall have been or ~rill be ccmplied with, In gr~nting <br />mny use permit, the City Council shall designate such conditions ~n connection <br />therewith as v~ll, ~n its opinion, assure that the use wili conform to the <br />foregoing requirements mhd that it will continue to do so. <br /> <br /> (e) No application for a use pe~Zt shall be accepted by the Plan- <br />ning Director wit~b_!n one year of the final action of the City Council upon a <br />prior application of the ssme ovmer conce_rnf~ the same use and the s~me <br />building, if ~ny, on subst~ntiallythe same !~nd. <br /> <br /> <br />
