AN ORD/3~&NCE TO CLOSE A PORTION OF MmcARTHUR A~YJE <br /> <br /> WHEREAS, Tarfa Corporation has made application to vacate and <br />close that hereinafter described portion of ~¢~cArthur Avenue; and <br /> <br /> ~, by resolution of this Council adopted Jmnua~y 27, 1970, <br />viewers were appointed pursuant to Section 15.1-364 of the Code of Vir- <br />ginia, 1950, as amended, to view the hereinafter described portion of the <br />said street and to report in writing whether in their opinion any and if- <br />any, what inconvenience would result from the discontinuing of the below <br />described street; and <br /> <br /> ~, the said viewers have reported in v~itlng that in their <br />opir~ion no inconvenience would result from closir~ and.discontinuir~ said <br />street; <br /> <br /> NOW, ~HEREFORE, BE IT 0RDALNED by the Council of the City of <br />Portsmouth, Virginia, that: <br /> <br /> MacArthur Avenue, as it lies between the western right <br /> ' of way line of mn extension of Perry Street and the <br /> northerm and easzern rmght of way line of High Street; <br /> <br />be mud the same is hereby closed and vacated as a pmblic street reserv~L~ <br />unto- the City of Portsmouth, however, the-perpetual eas~rent, ~_mgnt .... s~na <br />privilege to install, m~_intsin, operata and replace smnitary sewer and <br />water lines with~_n a strip of land twenty feet in ~idth, said strip lyirg <br />ten feet on each side of the center line of the portion of ~cArthur Ave- <br />nue described above. <br /> <br /> Adopted by the Coumci! of the City of Portsmouth~ Virgin!a, at <br />a meetirg held M~rch 24~ 1970. <br /> <br />Teste: <br /> <br />City'Clerk <br /> <br /> <br />
