That the Code of the City of Portsmouth, Virginia, 1961, be amended by amending Sec. 19-15 thereof and bym adding t~hereto a new.section numbered 19U15-1, such amended and new sections to read as f611ows: Sec. 19-15. Concealing o~ taking possession of ~rchandise; alter- ing price tags; transferrirg goods from one container to another; co~nsel~g~ etc., another'in performance · of such acts. Whoever, without authority, .with the intention of converting good~ or ~m?rch~dise to his own or auother's use,~Mithout having paid the~full p~rcnase price thereof, or of defrauding the oWner thereof ~ out of the value of the goods or merchandise, (i) w~llfully conceals or takes possession of the goods or merchandise of any store or other mercantile establis~aent, or ~(ii) alters the price tag or other price marking on such goods or n~rchan- ~iise, or transfers the goods from one contaiuer to another, or (iii) counsels, assists, aids or ab'ets another Ln the performanc& of any of the above acts~ shall be deemed guilty Of larceny and Upon conviction thereof shall be punished as provided by Sec.- 19-15.1. The willful concealment of goods or merchandise of any store or other mercantile establishment, while still on the prmmises thereof, shall be prLra facie evidence of an Lutent to convert and defraud the owner thereof out of the value of the goods or m~rchandise. Sec. 19-15.1 Punishment for con, fiction under Sec. 19-15. (a) Any person convicted for the first time of an offense under Sec. 19-15, when the value of the goods or mermhar~ise involved in the offehse is less than one hundred dollars, sbm~lI be guilty of a misdemeanor and shall be punished by a fine of not less tb~n the. value of the goods or merchandise involved nor more th~n one thousmud dollars, or by confinement in Jail not less than five days nor more than twelve months, or both, in the discretion~ of the jury or of the court trying the case without a jur~y.
