not be deemed to prohibit the defendsr~t from imtroducing on his behalf evi- <br />dence of the basis for his ref~sal to submit to the taking of a sample of <br />his blood to determine the alcoholic content thereof. The court shall <br />determine the reasonableness of such refusal. <br /> <br /> (n) If the court shall find the defendant g~itty as charged in <br />the v~mrrant~ the court shall suspend the defe~ant's license for a period <br />of ni~'nety days for a .first offense s~ad for six ~nths for a second or <br />sequent offense or refusal within one year of the first or other such re- <br />fusais; the ti~e shall be co~n~uted as follows: The date of'the first <br />offense and the date of the second or subsequent offense. <br /> <br /> (o) The court shall fo~ard the defendsmt's license to the <br />¢onm~issioner of the division of motor vehicles as in other cases of similar <br />nature for suspension of license unless~ however, the defendant s~.~] appeal <br />his con~iction~ im which case the court shall ret~m~n the license to the de- <br />fendant upon' his appeal being perfected. <br /> <br /> (p) The procedure for appeal and trial shall be the same as <br />provlded by law for misdemeanors. <br /> <br /> (q) No person arrested for violation of Section 18-52 shall be <br />required to execute in favor of a~ person.or corporation a waiver or release <br />of liability mn cormection with ~h~ wlthdr~;,~a~ of blood and as a condition <br />precedent to the ~thdrawal of blood as provided for herein. <br /> <br /> (r) The court or the jury trying the case s~hall determine the <br />· nnocence or the guilt of the defendsant from all the evidence conceding <br />his condition at the time of the alleged offense. <br /> <br /> (s) The steps herein set fo~h relatir~ to the taking, hs~ndling, <br />id~ntification~ smd disposition of blood samples are procedural in nature <br />~nd not substs_ntive. Subst~qtial co~tianoe therewith shall be deemed <br />to be sufficient. Failure to co~ly with tony one or more of such steos or <br />po~ions thereof~ or a vsriance in the results of the two blood tests ~hall <br />not of itself be gro~ads for finding the defend~nt not guilty, but shall <br />go to the weig~ht of the evidence and shall be considered as set forth above <br />~th all the evidence in the case, provided that the defend~at shall have <br />[ae right t8 introduce evidence on his o~m behalf to shm~ noncon~oliance <br />with the aforesaid preced~re or s-ny ps-~t thereof: ~nd that as a result <br />P~is rights ware preju~iced. <br /> <br />See. 18-143.1.
