when gra~ted or allowed and the decision of the 'chief of the fire <br />department thereon shall be entered upon the records of the depart- <br />me~t and a signed copy shall be furnished the applicant. <br /> <br />Section 11-23. Appeal to City Council <br /> <br /> In connection with the Fire Prevention Code~ 1970 Edition~ <br />adopted by section 11-19, whenever the chief of the fire department <br />shall ~isapprove an application or refuse to grant a license or per- <br />mit applied.for, or when it is claimed that the provisions of such <br />Fire Prevention .Code, 1970 Edition~ do not apply or that the true <br />intent and meaning of the code have been misconstrued or wrongly <br />interpreted, the applicant may appeal from the decision of the ~hief <br />of the fire department to the city council within thirty days from <br />the date of the decision from which the appeal is taken. <br /> <br />Section 1~-24.' Penalty for violation. <br /> <br /> A~ perso~ who shall violate any of the provisions of the <br />Fire Prevention Code~ 1970 Edition, adopted by section 11-19~ or <br />shal] fail to comply therewith, or who shall violate or fail to ~om- <br />ply with any ~rder made thereunder, or who shall build in violation <br />of any detailed statement of specifications or plans submitted and <br />approved thereunder, or any certificate or permit issued thereunder, <br />and from which no appeal has been taken, or who shall fail to comply <br />with such an order as affirmed or modified by the City Council or <br />by a court of competent jurisdiction, within the time f±xe~ therein, <br />shall severally for each and every such violati~ and non-compliance, <br />respectively, be guilty of a misdemeanor punishable by a fine of not <br />less than twenty-five dollars nor more than one thousand dollars or <br />by imprisonment for nov more than ~welve months or by both such fine <br />and imprisonment. The imposition of one penalty for any violavion <br />shall no~ excuse the violation or permit it ~o continue; and all <br />~uch persons shall be required to correct or remedy such violations <br />or defects within a reasonable time; and when not otherwise speci- <br />fied, each ten days that prohibited conditions are maintained shall <br />constitute a separate offense. <br /> <br /> The application of the above penalty shall not be held to <br />prevent the enforced removal of prohibited conditions. <br /> <br />ARTICLE IV. FIREWORKS <br /> <br />Section 11-24.1. Scope of article. <br /> <br /> (a) This article shall apply to fireworks as hereinafter <br />defined, except as provided in section (b) hereof. <br /> <br /> (b) Nothing in this article shall be construed to prohibit <br />any resident wholesaler, dealer~ or jobber to sell at wholesal~ such <br />fireworks as are not herein prohibited; or the sale of any kind of <br />fireworks provided the same are ~o be shipped directly~out of state <br />in accordanc'e with the Deparvmen~ of Transeortmtion Regulations covering <br /> <br /> <br />
