when gra~ted or allowed and the decision of the 'chief of the fire department thereon shall be entered upon the records of the depart- me~t and a signed copy shall be furnished the applicant. Section 11-23. Appeal to City Council In connection with the Fire Prevention Code~ 1970 Edition~ adopted by section 11-19, whenever the chief of the fire department shall ~isapprove an application or refuse to grant a license or per- mit applied.for, or when it is claimed that the provisions of such Fire Prevention .Code, 1970 Edition~ do not apply or that the true intent and meaning of the code have been misconstrued or wrongly interpreted, the applicant may appeal from the decision of the ~hief of the fire department to the city council within thirty days from the date of the decision from which the appeal is taken. Section 1~-24.' Penalty for violation. A~ perso~ who shall violate any of the provisions of the Fire Prevention Code~ 1970 Edition, adopted by section 11-19~ or shal] fail to comply therewith, or who shall violate or fail to ~om- ply with any ~rder made thereunder, or who shall build in violation of any detailed statement of specifications or plans submitted and approved thereunder, or any certificate or permit issued thereunder, and from which no appeal has been taken, or who shall fail to comply with such an order as affirmed or modified by the City Council or by a court of competent jurisdiction, within the time f±xe~ therein, shall severally for each and every such violati~ and non-compliance, respectively, be guilty of a misdemeanor punishable by a fine of not less than twenty-five dollars nor more than one thousand dollars or by imprisonment for nov more than ~welve months or by both such fine and imprisonment. The imposition of one penalty for any violavion shall no~ excuse the violation or permit it ~o continue; and all ~uch persons shall be required to correct or remedy such violations or defects within a reasonable time; and when not otherwise speci- fied, each ten days that prohibited conditions are maintained shall constitute a separate offense. The application of the above penalty shall not be held to prevent the enforced removal of prohibited conditions. ARTICLE IV. FIREWORKS Section 11-24.1. Scope of article. (a) This article shall apply to fireworks as hereinafter defined, except as provided in section (b) hereof. (b) Nothing in this article shall be construed to prohibit any resident wholesaler, dealer~ or jobber to sell at wholesal~ such fireworks as are not herein prohibited; or the sale of any kind of fireworks provided the same are ~o be shipped directly~out of state in accordanc'e with the Deparvmen~ of Transeortmtion Regulations covering
