AN ORDINANCE TO AMEND SECTIONS 4-57, 4-59, AND 4-59.1 <br />OF THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA, 1961, <br />PERTAINING TO THE MINIMUM HOUSING CODE. <br /> <br /> Be it ordained by the Council of the City of <br />Portsmouth, Virginia. <br /> <br /> 1. That sections 4-57, 4-59, and 4-59.1 of <br />the Code of the City of Portsmouth, Virginia, 1961, be <br />amended and reordained to read as follows: <br /> <br />Sec. 4-57. Generally. <br /> <br /> (a) Whenever the director finds that the <br />provisions of this article are being violated, the <br />director shall give written notice of such violation <br />to the person failing to comply with this article, <br />directing such person to comply within such reasonable <br />time as he shall in writing specify. <br /> <br /> (b) In addition to the notice required by <br />subsection (b) above, the director shall forthwith cause <br />to be posted on the premises that do not comply with this <br />article a notice substantially in the following form: <br /> <br />NOTICE. THESE PREMISES FAIL TO MEET THE <br /> MINIMUM HOUSING STANDARDS <br /> ESTABLISHED BY LAW. <br /> <br />It shall be unlawful for any person to deface or remove <br />such notice from such premises except with the permission <br />of the director. <br /> <br />Sec. 4-591 <br /> <br />Duty of recipient; procedure upon <br />noncompliance with notice to compl~ <br />with article. <br /> <br /> (a) Upon receipt of a notice ~iven pursuant to <br />section 4-57, the recipient shall: (1) Within the specified <br />period after the service upon him of such notice, commence <br />compliance with the directions thereof and complete such <br />compliance within a reasonable period thereafter; or (2) <br />within ten days after such service perfect an appeal to the <br />board. <br /> <br /> (b) Any such person who shall fail, refuse or <br />neglect to comply with provisions .of subsection (a) above <br />shall, upon a conviction thereof, be deemed guilty of a <br />misdemeanor and shall be punished in accordance with sec- <br /> <br /> <br />
