AN ORDINANCE TO CLOSE A PORTION OF BARCLAY AVENUE (FORMERLY ROSE AVENUE) FOR A DISTANCE OF APPROXIMATELY 130 FEET WEST OF THE NORTHWEST INTERSECTION OF BARCLAY AVENUE AND GEORGE WASHINGTON HIGHWAY. WHEREAS, Margaret C. Boze has made application to vacate and close the hereinafter described portion of a certain street; and WHEREAS, by resolution of this Council adopted November 23, 1971, viewers were appointed pursuant to Section 15.1-364 of the Code of Virginia, 1950, as amended to view the hereinafter described portion of the said street and to report in writing whether in their opinion any, and if any, what in- convenience would result from the discontinuing of the below described street; and WHEREAS, the said viewers have reported in writing that in their opinion no inconvenience would result from clos- ing and discontinuing said street; NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Portsmouth, Virginia, that all that certain strip of land, situate in the City of Portsmouth, Virginia, and described Ail that portion of Barclay Avenue (formerly Rose Avenue), beginning at the Northwest intersection o~ Barclay Avenue and George Washington ttighway, and running in a wester- ly direction along the North side of Barclay Avenue 129.48 feet to an iron pipe; thence South and perpendicular to the North side of Barclay Avenue 20 feet, more or less, to the South side of Barclay Avenue; thence East along the South side of Barclay Avenue 120 feet, more or less, to the West side of George Washington Highway, be and the same is hereby closed and vacated as a public street; provided, however, that the City of Portsmouth reserves unto itself the perpetual easement, right and privilege to maintain, operate and replace all public utility lines now situate within the area so closed and vacated.
