AN ORDINANCE TO CLOSE A PORTION OF BARCLAY AVENUE (FORMERLY <br />ROSE AVENUE) FOR A DISTANCE OF APPROXIMATELY 130 FEET WEST <br />OF THE NORTHWEST INTERSECTION OF BARCLAY AVENUE AND GEORGE <br />WASHINGTON HIGHWAY. <br /> <br /> WHEREAS, Margaret C. Boze has made application to <br />vacate and close the hereinafter described portion of a certain <br />street; and <br /> <br /> WHEREAS, by resolution of this Council adopted <br />November 23, 1971, viewers were appointed pursuant to Section <br />15.1-364 of the Code of Virginia, 1950, as amended to view the <br />hereinafter described portion of the said street and to report <br />in writing whether in their opinion any, and if any, what in- <br />convenience would result from the discontinuing of the below <br />described street; and <br /> <br /> WHEREAS, the said viewers have reported in writing <br />that in their opinion no inconvenience would result from clos- <br />ing and discontinuing said street; <br /> <br /> NOW, THEREFORE, BE IT ORDAINED by the Council of the <br />City of Portsmouth, Virginia, that all that certain strip of <br />land, situate in the City of Portsmouth, Virginia, and described <br /> <br /> Ail that portion of Barclay Avenue (formerly Rose <br />Avenue), beginning at the Northwest intersection o~ Barclay <br />Avenue and George Washington ttighway, and running in a wester- <br />ly direction along the North side of Barclay Avenue 129.48 <br />feet to an iron pipe; thence South and perpendicular to the <br />North side of Barclay Avenue 20 feet, more or less, to the <br />South side of Barclay Avenue; thence East along the South side <br />of Barclay Avenue 120 feet, more or less, to the West side of <br />George Washington Highway, be and the same is hereby closed and <br />vacated as a public street; provided, however, that the City <br />of Portsmouth reserves unto itself the perpetual easement, <br />right and privilege to maintain, operate and replace all public <br />utility lines now situate within the area so closed and vacated. <br /> <br /> Adopted by the Council of the City of Portsmouth, <br />Virginia, at a meeting held December 21, 1971. <br /> <br />Teste: <br /> <br />City Clerk <br /> <br /> <br />
