AN ORDINANCE TO CLOSE A PORTION OF HULL STREET BETWEEN BAGLEY <br />STREET AND FREDERICK BOULEVARD FOR A DISTANCE OF APPROXImaTELY <br />100 FEET. <br /> <br /> WHEREAS, Felix Sparks, Jr., Ida Sparks and John <br />Thomas, have made application to vacate and close the herein- <br />after described portion of a certain street; and <br /> <br /> WHEREAS, by resolution of this Council adopted <br />November 23, 1971, viewers were appointed pursuant to Section <br />15.1-364 of the Code of Virginia, 1950, as amended to view the <br />hereinafter described portion of the said street and to report <br />in writing whether in their opinion any, and if any, what in- <br />convenience would result from the discontinuing of the below <br />described street; and <br /> <br /> WHEREAS, the said viewers have reported in writing <br />that in their opinion no inconvenience would result from clos- <br />ing and discontinuing said street; <br /> <br /> NOW, THEREFORE, BE IT ORDAINED by the Council of the <br />City of Portsmouth, Virginia, that all that certain strip of <br />land, situate in the City of Portsmouth, Virginia, and described <br />as: <br /> <br /> BEGINNING at a point where the southern boundary line <br />of lot 336 as shown on the Plat of ~orth Truxton intersects the <br />east side of Bagley Street; thence running easterly a distance <br />of 95 feet to a point; thence running southerly a distance of <br />50 feet to a point; thence running westerly a distance of 100 <br />feet to a point on the east side of Bag!ey Street a distance of <br />50 feet to the point of beginning. Being that portion of Hull <br />Street east of Bagley Street, be and the same is hereby closed <br />and vacated as a public street; provided, however,~ that the City <br />of Portsmouth reserves unto itself the perpetual easement, right <br />and privilege to maintain, operate and replace all public util- <br />ity lines now situate within the area so closed and vacated. <br /> <br /> Adopted by the Council of the City of Portsmouth, <br />Virginia, at a meeting held December 21~ 1971. <br /> <br />Teste: <br /> <br />City Clerk <br /> <br /> <br />
