AN ORDINANCE TO CLOSE A PORTION OF HULL STREET BETWEEN BAGLEY STREET AND FREDERICK BOULEVARD FOR A DISTANCE OF APPROXImaTELY 100 FEET. WHEREAS, Felix Sparks, Jr., Ida Sparks and John Thomas, have made application to vacate and close the herein- after described portion of a certain street; and WHEREAS, by resolution of this Council adopted November 23, 1971, viewers were appointed pursuant to Section 15.1-364 of the Code of Virginia, 1950, as amended to view the hereinafter described portion of the said street and to report in writing whether in their opinion any, and if any, what in- convenience would result from the discontinuing of the below described street; and WHEREAS, the said viewers have reported in writing that in their opinion no inconvenience would result from clos- ing and discontinuing said street; NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Portsmouth, Virginia, that all that certain strip of land, situate in the City of Portsmouth, Virginia, and described as: BEGINNING at a point where the southern boundary line of lot 336 as shown on the Plat of ~orth Truxton intersects the east side of Bagley Street; thence running easterly a distance of 95 feet to a point; thence running southerly a distance of 50 feet to a point; thence running westerly a distance of 100 feet to a point on the east side of Bag!ey Street a distance of 50 feet to the point of beginning. Being that portion of Hull Street east of Bagley Street, be and the same is hereby closed and vacated as a public street; provided, however,~ that the City of Portsmouth reserves unto itself the perpetual easement, right and privilege to maintain, operate and replace all public util- ity lines now situate within the area so closed and vacated.
