304.14 Protective treatment. Ail exterior wood surfaces, other than decay resistant woods, shall be protected from the elements and decay by paint- ing or other protective covering or treatment. Such surfaces shall be painted or treated so as to prevent structural deteri- oration and neighborhood blight. Section 4-61.2 Rules and regulations for the administration and enforcement of this Article. The director of public health, wi~h the approval of the housing board of adjustments and appeals, m~y make and adoDt such rules and regulations as may be necessary for the admini- stration and enforcement of this article. Such rules and regu- lations shall not be in conflict with or an enlargement of any of the provisions of this article. It shall be unlawful for any person to fail, neglect or refuse to comply with such rules and regulations so adopted. Section 4-61.3 Noncompliance with article as nuisance and violation of lease or verbal rental agreement. In the judgment of any court of competent jurisdiction, the failure, refusal or neglect promptly to comply with the pro- visions of this article may be deemed a nuisance and a violation of the-.%erms ~ofeny tea-se or ,v~rbat ren%'al~greemSnto Substan- tial failure, refusal or neglect by the occupant shall be grounds. for eviction in any action by the owner. Substantial failure, refusal or neglect by ~he owner or occupant shall be grounds for the cancellation of such lease or verbal rental agreement in an action by the party not guilty of such .non-compliance. Section 4-61.4 Authority of director of public health to abate nuisance notwithstanding provisions of article. Notwithstanding any of the provisions of this article, whenever in the judgment of the director there exists upon any land or premises or in any dwelling unit any condition ~hat . constitutes such a nuisance or menace to health that the same should be remediedr abated or removed immediately, the director may proceed in accordance with the progisions of sections 14-1 and 14-2. 3. That the Code of the City of Portsmouth, Virginia, 1961, be amended by adding thereto six new sections numbered 4-61.5 through 4-61~10 inclusive, such new sections to read as fo!.lows: -3-
