Procedure Upon Denial of Application. In the event the recommendation of the commission is to deny the application to remove an official marker or to demolish or alter a building as provided for in Section 9-2~, it shall at the same time reco~ena whether or not the building ~hould be acquired, leased or o~h~zse~ealt with~in acco_o~nce~th law. The ~uild- ing Ozfzc_al shall forward L~ediately such report to the City ~anager for transmittal to the Council at its next regular meet- ing ~ogether with any co~ents which he may deem appropriate. At the sa/r~e time, the Building Official shall notify the owner of such action and the owner shall not remove the ozfzclat marker, nor demolish, nor alter the structural exterior appearance of the building until tke expiration of six months from the date on which the owner's application was received unless authorized by the Council. The Buztamng Official shall not issue a permit to demolish or alter any such building until 5he expiration of six months from the date on which a copy of such application was received by ~im unless authorized by the Council. Section 9-27. Unauthorized Removal or Demolition of Building. It shall be unlawful for any person, whether as owner, con- tractor or othe~ise, who knows or has reason to believe that a building is a historic building as set forth in ~his article, to cause or participate in the removal of an official marker or in the demolition or alteration of a building in violation of the provisions of this article. Sections 9-2S. Acceptance and Disposition of Gifts, Devises, etc., Toward Preservation of Historic Build- ings. Ail persons interested in the preservation of historic build- ings in the city are invited to make gifts~ devises and bequests to the city to be used for that purpose~ Ail such donations, other than money, shall be subject to acceptance by the City Council. All donations of money shall be made through the City Auditor's Office, and it is hereby authorized and directed to-receive such donations and to deposit them in a special fund to be known as the historic buildings trust fund, which shall be used only for the purpose of preserving and promoting the preservation ~f historic buildings in ~e city. Bxpenditures from such fund shall be made by the City ~lanager as authorized from time to time by the City Council. -18-
