application to remove an official marker or to demolish or alter <br />a building as provided for in Section 9-24, the Building Official <br />shall i~._etately so advise the owner. <br /> <br />Section 9-26. Procedure Upon Denial of Application. <br /> <br /> In the event the recommendation of the commission is to deny <br />the application to remove an official marker or to demolish or <br />alter a building as provided for in Section 9-2~, it shall at the <br />same time reco~ena whether or not the building ~hould be acquired, <br />leased or o~h~zse~ealt with~in acco_o~nce~th law. The ~uild- <br />ing Ozfzc_al shall forward L~ediately such report to the City <br />~anager for transmittal to the Council at its next regular meet- <br />ing ~ogether with any co~ents which he may deem appropriate. At <br />the sa/r~e time, the Building Official shall notify the owner of <br />such action and the owner shall not remove the ozfzclat marker, <br />nor demolish, nor alter the structural exterior appearance of <br />the building until tke expiration of six months from the date <br />on which the owner's application was received unless authorized <br />by the Council. The Buztamng Official shall not issue a permit <br />to demolish or alter any such building until 5he expiration <br />of six months from the date on which a copy of such application <br />was received by ~im unless authorized by the Council. <br /> <br />Section 9-27. Unauthorized Removal or Demolition of <br /> Building. <br /> <br /> It shall be unlawful for any person, whether as owner, con- <br />tractor or othe~ise, who knows or has reason to believe that a <br />building is a historic building as set forth in ~his article, to <br />cause or participate in the removal of an official marker or in <br />the demolition or alteration of a building in violation of the <br />provisions of this article. <br /> <br /> Sections 9-2S. Acceptance and Disposition of Gifts, Devises, <br /> etc., Toward Preservation of Historic Build- <br /> ings. <br /> <br /> Ail persons interested in the preservation of historic build- <br />ings in the city are invited to make gifts~ devises and bequests to <br />the city to be used for that purpose~ Ail such donations, other <br />than money, shall be subject to acceptance by the City Council. All <br />donations of money shall be made through the City Auditor's Office, <br />and it is hereby authorized and directed to-receive such donations <br />and to deposit them in a special fund to be known as the historic <br />buildings trust fund, which shall be used only for the purpose of <br />preserving and promoting the preservation ~f historic buildings <br />in ~e city. Bxpenditures from such fund shall be made by the <br />City ~lanager as authorized from time to time by the City Council. <br /> <br />-18- <br /> <br /> <br />
