AN ORDINANCE TO k~END THE CODE OF THE CITY OF PORTSMOUTH, <br />VIRGINIA, 1961, BY ADDING THERETO A NEW SECTION NUMBERED <br />19-84, RELATING TO ILLEGAL USE OF CERTAIN NOXIOUS SUBSTA~CES <br />OR CHEMICALS. <br /> <br /> Be it ordained by the Council of the City of Ports- <br />mouth, Virginia: <br /> <br /> i. That the Code of the City of Portsmouth, Virginia, <br />1961, be amended by adding thereto a new section numbered 19-84, <br />such new section to read as follows: <br /> <br />Section 19-84. Inhaling drugs or other noxious chemical sub- <br /> stances or causing, etc., others to do so. <br /> <br /> (a) It shall be unlawful for any person deliberately <br />to smell or inhale any drugs or any other noxious chemlcat sub- <br />stances including but not limited to fingernail polish or model <br />airplane glue, containing any ketones, aldehydes, organic acetates, <br />ether, chlorinated hydrocarbons or vapors, in such excessive <br />quantities as to cause conditions of intoxication, inebriation, <br />excitement, stupefaction or dulling of the brain or nervous <br />system. Any person violating the provisions of this subsection <br />shall be guilty of a misdemeanor. <br /> <br /> (b) It shall be unlawful for any person, other than <br />one duly licensed, deliberately to cause, invite or induce any <br />person to smell or inhale any drugs or any other noxious sub- <br />stances or chemicals containing any ketone, aldehydes, organic <br />acetates, ether, chlorinated hydrocarbons or vapors in such <br />excessive quantities as to cause conditions of intoxication, <br />inebriation, excitement, stupefaction or dulling of the brain <br />or nervous system. Any person violating the provisions of this <br />subsection shall be guilty of a misdemeanor and upon conviction <br />thereof shall be fined not more than five hundred dollars and <br />be confined in jail not exceeding six months, either or both. <br /> <br /> Adopted by the Council of the City of Portsmouth, <br />Virginia, at a meeting held July 27, 1971. <br /> <br />Teste: <br /> <br />City Clerk <br /> <br /> <br />
