AN ORDINANCE TO k~END THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA, 1961, BY ADDING THERETO A NEW SECTION NUMBERED 19-84, RELATING TO ILLEGAL USE OF CERTAIN NOXIOUS SUBSTA~CES OR CHEMICALS. Be it ordained by the Council of the City of Ports- mouth, Virginia: i. That the Code of the City of Portsmouth, Virginia, 1961, be amended by adding thereto a new section numbered 19-84, such new section to read as follows: Section 19-84. Inhaling drugs or other noxious chemical sub- stances or causing, etc., others to do so. (a) It shall be unlawful for any person deliberately to smell or inhale any drugs or any other noxious chemlcat sub- stances including but not limited to fingernail polish or model airplane glue, containing any ketones, aldehydes, organic acetates, ether, chlorinated hydrocarbons or vapors, in such excessive quantities as to cause conditions of intoxication, inebriation, excitement, stupefaction or dulling of the brain or nervous system. Any person violating the provisions of this subsection shall be guilty of a misdemeanor. (b) It shall be unlawful for any person, other than one duly licensed, deliberately to cause, invite or induce any person to smell or inhale any drugs or any other noxious sub- stances or chemicals containing any ketone, aldehydes, organic acetates, ether, chlorinated hydrocarbons or vapors in such excessive quantities as to cause conditions of intoxication, inebriation, excitement, stupefaction or dulling of the brain or nervous system. Any person violating the provisions of this subsection shall be guilty of a misdemeanor and upon conviction thereof shall be fined not more than five hundred dollars and be confined in jail not exceeding six months, either or both.
