AN ORDINANCE TO AMEND THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA, 1961 BY AMENDING SECTION 18-139 THEREOF PERTAINING TO THE RELEASE OF IMPOUNDED AUTOMOBILES. Be it ordained by the Council of the City of Portsmouth, Virglnla: 1. That the Code of the City of Portsmouth, Virginia, 1961, be amended and reordained to read as follows: Sec. 18-139. Release from impoundment upon payment of charges and costs. No motor vehicle, trailer or semitrailer impounded under the provisions of this division shall be released or removed from the city pound except upon payment by the owner thereof, or his duly authorized representative, to the chief of police, who shall issue a receipt therefor, of a towing charqe of fifteen dollars, plus a storage charge, if the motor vehicle, trailer or semi- trailer has been impounded for a period longer than twenty-four hours, of one dollar per day or fraction thereof, plus cost of publication of any notice required by any of the provisions of this Code, plus cost of investigation as to ownership and liens required by any of the provmsions of this division; provided, that the city manager may release any such impounded motor ve- hicle, trailer or semitrailer from the city pound without the pay- menn of such charges and costs, or any part thereof, whenever he deems it proper so to do. Such owner, or his duly authorized rep- resentative, upon delivery of the motor vehicle, trailer or semi- trailer to him, shall sign a receipt for the same. The payment of cosns herein set forth, or the release of any impounded motor ve- hicle, trailer or semitrailer, without the payment of any or all of such costs, shall not operate to relieve the offender from the liability of any fine or penalty for the violation of any law or ordinance on account of which the motor vehicle, trailer or semi- trailer was impounded.
