AN ORDINANCE TO A~ND THE ZONING ORDINANCE OF THE CITY OF PORTSMOUTH, VIRGINIA, 1961, BY ADDING THERETO A NEW ARTICLE NUMBERED 5A, CONSIST- ING OF SECTIONS 5A-1 THROUGH 5A-16, PERTAINING TO PLAY'NED UNIT DE- VELOP~NT IN AREAS ZONED RESIDENTIY~. Be it ordained by the Council of the City of Portsmouth, Virginia: 1. That the Zoning Ordinance of the City of Portsmouth, Virginia, 1961, be ~ended by adding thereto a new article nuEubered 5A, consisting of Sections 5A-! through 5A-16, s~ch new article to read as follov~s: Article 5A - Planned Unit Development in Residential Areas. Section 5A-1. Objectives and Purposes. The objectives and purposes of this article are: (a) The encou~ragement of more efficisnt and aesthetic use of open land; (b) The encouragement of the reservation of open space for scenic and recreational use of a private or public nature; (c) The encouragement of the reservation of land for schools or other public buildings; (d) To provide incentives for development to encourage and create a wide range of choice to satisfy the changing needs of the community; {e) To offer flexibility to the dev~10per-in his proach and solution to land development problems.~' ~. Section 5A~2. Planned Unit Development Defined. ap- A planned unit development is def~-n~d as an area of land under a unified ownership or control to be developed and improved as a whole in a single development operation or a prggrammed series of development operations for dwelling units and rel~{~d uses and facilities. The plan and development program includes not only land improvements such as streets and utilities but also all structures as proposed to be located, constructed and used. Also included may be programs for_provision, operation and maintenance of areas, facititzes and functions for common use by all or sub- stantial portions of the occupants and which normally will not be operated and maintained at the expense of ~he City of Portsmouth.
