AN ORDINANCE TO ~2[END TEE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA, <br />196!, BY ~[ENDING SECTIONS 4-73 THROUGH 4-~79 THEREOF, PERTAINING <br />TO CLOSURE OF VACD~.~T OR UNOCCUPIED BUILDINGS AND REGISTRATION AND <br />pEEi~ITS THEREFOR. <br /> <br /> Be it ordained by the Council of the City of Portsmouth, <br />Virginia: <br /> 1. That the code of the City of Portsmouth, Virginia, <br />1961, be amended and reordained to read as follows: <br /> ARTICLE V. Vacantor Unoccupied Buildings. <br /> <br />Section 4-73. Definitions. <br /> ,,Owner'~. Owner shall mean theholder of title in fee <br />simple and any person, group of persons, company, association or <br />corporation in whose name tax bills on the property are submitted. <br />It shall also mean any person who alone or jointly or severally <br />with others: <br /> <br /> (a) shall have legal title to any dwelling or <br /> dwelling unit with or without accompanying ac- <br /> tual possession thereof; <br /> <br /> (b) shall have charge, care or control of any <br /> dwelling or dwelling unit as ovmer, executor, <br /> executrix, administrator, trustee, guardian of <br /> the estate of the owner~ mortgagee, or vendee <br /> in possession, assignee of rents, lessee or <br /> other person~ firm Sr corporation in control <br /> of a building; or their duly authorized agents. <br /> Any such person, group of persons, company, association <br /> or corporation shall have joint and several responsibility for com- <br /> pliance with the provisions of this article. <br /> "Vacant or unoccupied building". A vacant or unoccupied <br /> building shall be any building or structure which zs not occupied, <br /> used or inhabited on a regular and continuing basis by some person <br /> with a valid claim of right to possession or a fee simple title. <br /> The intrusion of trespassers or squatters into such buildings on <br /> any basis shall not render such building occupied or non-vacant <br /> within the meaning of this article. <br /> <br /> Section 4-74. Closure of vacant or unoccupied buildings. <br /> The owner of any building shall, whenever the same is or <br /> becomes vacant or unoccupied, remove therefrom all paper or other <br /> <br /> <br />
