1972rlO2 <br /> <br />AN ORDINANCE TO AMEND THE CODE OF THE CITY OF PORTSMOUTH, VIR- <br />GINIA, 1961, BY REPEALING SECTIONS 10-59 AND 10-102 THEREOF AND <br />BY AMENDING SECTIONS 10-5, 10-14, 10-18, 10-19, 10-20, 10-94 <br />AND 10-98 THEREOF PERTAINING TO TRANSFER OF APPROPRIATIONS, <br />APPROPRIATION ORDINANCES AND RESOLUTIONS, BORROWING BY MEANS OF <br />NOTES, INTEREST AND PENALTIES FOR NON-PAYMENT OF AMUSEMENT TAXES, <br />EXEMPTIONS FROM AMUSEMENT TAXES. <br /> <br /> Be it ordained by the Council of the City of Ports- <br />mouth, Virginia: <br /> <br /> 1. That the Code of the City of Portsmouth, Virginia, <br />1961, be amended by repealing Sections 10-59 and 10-102 thereof. <br /> <br /> 2. That the Code of the City of Portsmouth, Virginia, <br />1961, be amended and reordained to read as follows: <br /> <br />Section 10-5. Transfers of appropriations. <br /> <br /> (a) The Director of Finance may at any time trans-' <br />fer any unencumbered appropriation balance or portion thereof <br />within the same general classification of expenditures within <br />an office, department or agency. <br /> <br /> (b) In the event that the City Council shall <br />make appropriations for an emergency contingency fund, the City <br />Manager may thereafter transfer any or all of the unencumbered <br />portion thereof to any item of expense contained in the city <br />budget, reporting such action and reason therefor to the Council <br />at its next regular meeting. <br /> <br /> (c) The City Manager may at any time during the <br />fiscal year transfer any unencumbered appropriation balance not <br />to exceed $10,O00.OO from one department to another department. <br /> <br />Section 10-14. Appropriation ordinances or resolutions - <br /> generally. <br /> <br /> No ordinance or resolution appropriating money shall be <br />valid unless it shall be passed by the recorded affirmative vote <br />of the majority of all the members elected to the Council. <br /> <br />Section 10-18. Notes to meet appropriations for current year. <br /> <br /> The City Manager and the Director of Finance are author- <br />ized to make notes, through the proper officers, to borrow money <br />for the purpose of meeting appropriations made for the then current <br />year in anticipation of the collection of the taxes and revenues <br />of such fiscal year, and within the amount of such appropriations, <br /> <br /> <br />
