AN ORDINANCE TO AME~D CHAPTER 32 OF THE CODE OF THE CITY OF PORTS- <br />MOUTH, VIRGINIA, 1961, SUCH CHAPTER BEING THE SUBDIVISION ORDINANCE <br />OF THE CITY OF PORTSMOUTH, BY ADDING SECTION 32-19.1 THERETO PER- <br />TAINING TO REQUIRED OFF-SITE DRAINAGE IMPROVemENTS. <br /> <br /> Be it ordained by the Council of the City of Portsmouth, <br />Virginia: <br /> <br /> 1. That Chapter 32 of the Code of the City of Portsmouth, <br />Virginia, 1961, be amended by adding thereto Section 32-19.1, such <br />section to read as follows: <br /> <br />Section 32-19.1. Off-site drainage improvements. <br /> <br />Whenever the subdivisio~ or development of land may <br />cause or contribute to the need for off-site drainage facilities <br />(facilities other than those required to provide internal drainage <br />within the subdivision or development) to control the flow of <br />storm water, the subdivider shall be required to provide for or <br />contribute to the installation of such facilities in one or both <br />of the following manners <br /> <br /> A. Construct such off-site drainage facilities <br /> in accordance with plans and specifications ap- <br /> proved by the city engineer. Construction by <br /> the developer shall be undertaken only if per- <br /> mitted by the city engineer. The subdivider <br /> shall pay the cost or so much thereof as the <br /> city shall direct. <br /> <br /> B. Contribute his pro rata share of the costs <br /> of such facilities as are needed to properly <br /> control storm water flow in a designated drai~- <br /> age area, said share to be calculated as follows: <br /> <br /> (1) Drainage area~ shall be designated b~ <br /> the city engineer in accordance with soun~ <br /> engineering principles. <br /> <br /> (2) Off-site drainage facilities needed to <br /> properly control present and anticipated <br /> storm water flow in such areas shall be de- <br /> signed by the department of engineering in <br /> accordance with sound engineering principles <br /> taking into consideration (among other things) <br /> the zoning and zoning patterns of the subject <br /> drainage area, the duration and frequency of <br /> rainfall in such area during a storm return <br /> <br /> <br />
