AN ORDINANCE TO AMEND THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA, <br />1961, BY ADDING THERETO A NEW SECTION NUMBERED 19-89 PROHIBITING <br />MASSAGES OR BATHS ADMINISTERED BY A PERSON OF THE OPPOSITE SEX. <br /> <br /> Be it ordained by the Council of the City of Portsmouth, <br />Virginia: <br /> <br /> 1o That the Code of the City of Portsmouth, Virginia, <br />1961, be amended by adding thereto Section 19-89, such added <br />section to read as follows: <br /> <br />Section 19-89. Certain massages, baths, etc. administered by <br /> persons of the opposite sex prohibited. <br /> <br /> (a) It shall be unlawful for any establishment, <br />either public or private, to operate a massage salon, bath parlor <br />or similar business, where any massage, ba%h or similar service <br />involving physical contact is administered by a person of the <br />opposite sex. <br /> <br /> (b) This section shall not apply to a physician, <br />surgeon, chiropractor, osteopath or physical therapist duly li- <br />censed by the Commonwealth of Virginia, or to other duly licensed <br />or authorized health care personnel administering health services <br />to patients under their care. Also, this section shall not a'pply <br />to barber shops or beauty parlors in which massages are given to <br />the scalp, the face, the neck or shoulders. <br /> <br /> 2. An emergency exists and this ordinance shall take <br />effect from the date of its passage. <br /> <br /> Adopted by the Council of the City of Portsmouth, Vir- <br />ginia, at a meeting held August 8, 1972. <br /> <br />Teste: <br /> <br />City Clerk <br /> <br /> <br />
