Furthermore, no electric power company shall cor~mence <br />individual service to a dwelling unit unless it has determined <br />that a valid and effective Certificate of Compliance has been <br />issued therefor as hereinafter required or that a waiver as per- <br />mitted by Section 4-61.8 has been granted. <br /> <br />Section 4-61.8. Waivers. <br /> <br /> (a) Any applicant whose rental property ia inspected <br /> and found not to be in compliance with the Code may petition <br /> the director in writing for a temporary waiver of compliance. <br /> The petition shall be on a form provided by th~ director and <br /> shall contain the information therein requeste~ and which may <br /> be reasonably necessary to its decision, and shall include a <br /> written statement, signed by the applicant, acknowledging the <br /> actions needed, specifying the anticipated date of beginning <br /> and completion of the work, and if known, the name of t/~.e per- <br /> son or company which will perform the work. If the director <br /> finds that (1) the delay in the Correction of the violation is <br /> reasonable, taking into consideration the availability of <br /> qualified persons to do the work and the current work load; <br /> and that (2) the work can reasonably be undertaken and com- <br /> pleted while the premises are occupied or that appropriate <br /> p~ovision has been made for housing the tenant elsewhere dur- <br /> ing the period when the dwelling unit will not be habitable. <br /> because of the work of correcting the violation; the director <br /> shall issue a temporary waiver of compliance, which will allow <br /> a reasonable period of time to achieve compliance. This period <br /> shall never be less than thirty days, nor more than 120 days. <br /> App~licant shall, on or before said date, request a reinspect- <br />ion and pay.the reinspection fee. <br /> <br /> (b) No waiver granted under this section shall be <br />valid unless in writing and signed both by the director or his <br />delegate and the applicant. No waiver shall be extended for <br />any period of time except upon appeal to the Board of Minim~ <br />Housing. No appeal shall be considered by the Board unless <br />filed at least fifteen (15) days prior to the expiration of the <br />previous waiver. Where the Board finds that a hardship would <br />result or that extraordinary circumstances warrant additional <br />time, it may grant an extension of time up to sixty (60) days <br />beyond the expiration date of the waiver. The provisions for <br />extension of time contained herein shall be a remedy provided <br />in addition to the appeal procedures of Section 4-61.9. <br /> <br />Section 4-61.11. Penalties. <br /> <br /> Any person, firm, corporation or agent who violate~ <br />or fails to comply with the provisions of this article shall be <br />guilty of a misdemeanor.
