(a) The franchisee shall construct its facilities and extend its cables, amplifiers and related equipment throughout the franchise area as rapidly as possible, within three (3) years from the date of issuance of a certificate of compliance by the Federal Communications Corm~ission, the franchisee's in- stallations shall be capable of furnishing bssic service to every potential subscriber within 30 days of application for such service throughout the franchised territory. The franchisee shall extend its cables,-amplifiers, etc., so as to be capable of pro- viding basic service to at least 33 1/3% of the city's potential subscribers during the first year of such three year period, an additional 33 1/3% before the end of the second year and an addi- tional 33 1/3% before the end of the third year. Certain areas of the city may be designated in the franchise as priority con- struction areas to be built within a designated time period to insure that construction and extension of service is accomplished in a uniform, equitable and non-discriminatory manner. (b) The franchisee shall lay an additional cable as required hereinafter by section 5A-21 at the same time and in ac- cordance with the schedule set forth in (a) above, such cable to provide the capability of extending additional service when re- quired or allowed to do so by the council. In requiring the ex- tension of additional servicer the council will consider the state of the art and economic feasibility of the type of additional service proposed. (c) The council may designate in the franchise certain areas of the city as priority construction areas to be built with- in a designate~ time period so as to insure extension of basic service or additional service [in accordance with (b) above] to designated city~ school board or other government buildings. (d) The franchisee shall submit an application for a certificate of compliance to the FCC within 120 days of the date of award of franchise and shall obtain such certificate from the FCC within one year of such date or the franchise granted hereby may be declared to be null and void.
