of the code no bidder, interested party, citizen or agency will <br />be permitted to address council on subject of the award of <br />this franchise except at the public hearing required by (c] above. <br /> <br />Article V. Term. <br /> <br />Section 5A-9. Term; renewal. <br /> <br /> (a) The franchisegranted hereby shall be for an initial <br />term of fifteen (15) years unless sooner tarminated as set forth in <br />sections 5A-73 or 5A-74 hereof. <br /> <br /> (b) The franchise granted hereby may be renewed by council <br />for an additional period of five (5) years upon the written request <br />of the franchisee submitted one (1) year prior to the expiration <br />of the original term. The council may require changes to be made <br />in the original franchise as a condition or conditions of such re- <br />newal. Such renewal shall be at the sole discretion of the council <br />and nothing in this prov!sion or elsewhere in this chapter shall be <br />construed as requiring such renewal. <br /> <br />Section 5A-10. ~ssignment or transferral of franchise prior <br /> to completion of construction. <br /> <br /> The franchise as granted herein shall not be assigned or <br />transferred, either in whole or in part, or leased, sublet or <br />mortgaged (except as permitted by section 5A-13(d)) in any manner, <br />nor shall title thereto, either legal or equitable, or any right~ <br />interest or property therein, pass to or vest in any person, either <br />by act of the franchisee or by operation of law prior to completion <br />of construction as specified in section 5A-18 until the franchise <br />has been reawarded in accordance with the procedure set forth in <br />sections 5A-7 through 5A-8 hereof. <br /> <br />Section 5A-11. Foreclosure. <br /> <br /> Upon the foreclosure or other judicial sale of all or a <br />substantial part of the system, or upon the termination of any lease <br />covering all or a substantial part of the system, the franchisee <br />shall notify the council of such fact, and such notification shall <br />be treated as a notification that a change in control of the fran- <br />chisee has taken place, and the provisions of section 5A-13(c) of <br />this ordinance, governlng the consent of the council to such change <br />in control of the franchisee, shall apply. <br /> <br />Section 5A-12.
