between franchise provisions and such state and federal law, the <br />latter will govern. Amendments to such state and federal law, and <br />especially FCC rules and regulations, which materially affect the <br />provisions of said franchise shall be incorporated promptly by <br />amend~ent thereto but no later than one year from the effective <br />date of such amendments or if within one year of expiration of the <br />franchise or any renewal thereof the changes shall be incorporated <br />prior to such date. <br /> <br />Section 5A-6. Franchise non-exclusive. <br /> <br /> The franchise granted in pursuance hereof shall be <br />non-exclusive. <br /> <br />Article IV. Award of Franchise. <br /> <br />Section 5A-7. Request for bids. <br /> <br /> Before granting any franchise, the council shall re- <br />quest bids therefor by advertisement in the manner set forth <br />in section 2.09 of the Charter of the City of Portsmouthr 1970, <br />as amended° The form of such request for bids and the terms <br />and conditions thereof shall be as determined by the city <br />manager after consultation with the commission. <br /> <br />Section 5A-8. Receipt of bids and consideration thereof. <br /> <br /> (a) Such bids as are received shall be examined for <br />compliance with the terms of the bid solicitation. Non-com- <br />pliance with any of the terms of the bid solicitation may result <br />in exclusion of such bid from consideration. <br /> <br /> (b) Ail bids received and not excluded as set forth <br />in (a) above shall be considered by the commission and a <br />recommendation thereon shall be filed with the council within <br />60 days of receipt of bids. <br /> <br /> (c) Within 30 days of receipt of bids the council <br />shall advertise and hold a public hearing at which all bona <br />fide bidders [except those excluded as set forth in (a) above] <br />and any i~terested party, citizen or agency may participate. <br /> <br /> (d) After receiving and considering the recommen- <br />dation of the co~mission~ the council shall award the franchise <br />to the bidder tendering the most mer!torious proposal and shall <br />direct the execution of a franchise agreement therewith. <br /> <br />(e) Notwithstanding the provisions of section 2-24 <br /> <br />-5- <br /> <br /> <br />
