.~ ORDINANCE TO ~END THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA, <br />1961, BY ADDING THERETO CHAPTER 5A PERTAINING TO CABLE TELA~YISI©N <br />CO~UNICATiONS SYST~qS AND F~ANCHISES THEREPOR. <br /> <br /> BE IT ORDAINED by the Council of the City of Portsmouth, <br />Virginia, that: <br /> <br /> 1. The Code of the City of Portsmouth, Virginia, 1961, <br />be ~ended by adding thereto Chapter 5A and Sections 5A-I through <br />5A-80 therein, suc5 new chapter and sections to read as follows: <br /> <br />Chapter 5A. Cable Television Communications Systems. <br /> <br />Article I. Purpose. <br /> <br />Section SA-1. Purpose. <br /> <br /> The purpose of this chapter is to provide for the <br />orderly development, design, construction, operation~ maintenance <br />and regulation of a cable television communications system or <br />systems for the City of Portsmouth. <br /> <br />Article II. Definitions. <br /> <br />Section 5A-2. ~efinitions. <br /> <br /> The following words, terms and phrases when used in <br />this chapter shall, for the purposes of this chapter, have the <br />meanings respectively ascribed to them in this section except <br />in those instances where the context clearly indicates a different <br />meaning: <br /> <br /> "Cable Casting, Origination and Access" shall mean <br />programing exclusive of broadcast signals carried on a cable <br />television system. Origination cablecasting is programing (ex- <br />clusive of broadcast signals) carried on a cable television system <br />over one or more channels and subject to the exclusive control <br />of the cable operation. Access cablecasting is the provision of <br />services (exclusive of broadcast signals) by a cable television <br />system on its pub~.ic, educational, local government or leased <br />channels. <br /> <br /> "Cable Television Communications System. Cable System, <br />CA~; System, System'~ shall mean any facility that, in whole or <br />in part, receives directly, or indirectly over the air and amplifies <br />or otherwise modifies the signals transmitting progr~T~s broad- <br />cast by one or more television or radio stetions and distributes <br /> <br /> <br />
