AN ORDINANCE CLOSING A PORTION OF GRIFFIN STREET BETWEEN THE <br />EASTERN RIGHT OF WAY LINE OF' FIFTH STREET AND THE RIGHT OF WAY <br />OF TRE SEABOARD COASTLINE RAILROAD COMPANY '(S-73-11) · <br /> <br /> WHEREAS, John J. Kelley Corporation and Rank <br />Associates have made application to vacate, close and discon- <br />tinue the hereinafter described portion of Griffin Street; and <br /> <br /> WHEREAS, by resolution of this Council, adopted <br />July 24, 1973, viewers were appointed pursuant to Section <br />15.1-364 of the Code of Virginia (1950) as amended, to view the <br />hereinafter described portion of the said street and to report <br />in writing whether in their opinion, any, and if any, what <br />inconvenience would result from discontinuing the below described <br />street; and <br /> WHEREAS, the said viewers have reported in writing <br /> that in their opinion no inconvenience would result from closing <br /> and discontinuing said street. <br /> <br /> NOW, THEREFORE, BE IT ORDAINED by the Council of the <br /> City of Portsmouth, Virginia~ that that portion of Griffin Street <br /> hereinafter described, be closed and vacated as a public street. <br /> <br /> Ail that certain piece or parcel of <br />land lying and being in the City of Portsmouth, <br />Virginia, and comprising that portion of <br />Griffin Street located between the eastern <br />right of way of Fifth Street and the right <br />of way of the Seaboard Coastline Railroad <br />Company. <br /> <br /> AND, BE IT FURTHER ORDAINED that the whole of such <br /> portion to be closed shall be subject to a perpetual easement <br /> · . an~ight of way ~etaine~ in favor of the City of Portsmouth for <br />· '/the..cons%r~c~i0n, operation, maintenance and repair of storm <br /> drain'and Sanitary sewer facilities. <br /> <br /> Adopted by the Council of the City of Portsmouth, <br />U~rg~n~ , at a meeting held September 11, 1973. <br /> <br />Teste: <br /> <br /> ~lerk <br />~" City <br /> <br /> <br />
