AN ORDINANCE TO AMEND THE CODE OF THE CITY OF PORTSMOUTH, VIR- <br />GINIA~ 1961, BY AMENDING SECTIONS 26-65 and 26-76 THEREOF PER~ <br />TAINING TO THE PORTSMOUTH FIRE AND POLICE RETIREMENT SYSTEM. <br /> <br /> Be it ordained by the Council of the City of Ports- <br />mouth~ Virginia: <br /> <br /> !. That the c~de of the City of Portsmouth, Virginia, <br />1961, be amended by amending Sections 26-65 and 26-76 thereof~ <br />such amended sections to read as follows: <br /> <br />Section 26-65. Period of membership;~cessation of membership. <br /> <br /> (a) Each employee who becomes a member of the system <br />shall continue to be a member so long as he remains an employee <br />and so long thereafter as he is entitled to future benefits under <br />any provision of the system. Not in limitation but in amplifi- <br />cation of the foregoing, the meir~ership of any person in the <br />system shall cease: <br /> <br /> (1) Upon his termination of service as an employee, <br />other than by retirementr before he has completed ten <br />years of creditable servicer provided, however, that <br />for purposes of this section the entrance of a me~nfoer <br />into authorized leave of absence shall not constitute <br />termination of service as an employee provided the <br />member re-enters service as an employee at the ex- <br />piration of the period of authorized leave, and the <br />entrance of a member into the Armed Forces of the United <br />States shall not constitute termination of service as <br />an employee provided the member's service in such ~med <br />Forces qualifies as creditable service under section <br />26~69; or ~ <br /> <br /> ---(2) Upon the cessation of his retirement allow- <br />ance~ unless in such event he immediately again be- <br />comes ail employee; or <br /> <br /> (3) Upon his death. <br /> <br /> (b) Should any person terminate service as an employee, <br />other'than by re~eme~t under the provisions of this article, <br />and should such person at any time again become an employee, whe- <br />ther or not his ~embership continued~ he shall for all purposes <br />of this article.~e considered a new employee and a new member, <br />and any benefits becoming payable under the provisions of this <br />article'shall be computed separately for each period of service. <br /> <br /> <br />
