BY AMENDIN~ ~'~'~O~o- , <br />GINIA. 1961, _ EMENTAL RETIREMENT SYSTEM- <br />THEREOF PERTAINING TO THE PORTSMOUTH SUPPL <br /> <br /> Be it ordained by the Council of the City of Ports- <br />mouth, Virginia: <br /> 1. T~at the code of the City of Portsmouth, Virginia, <br /> t961~ be amended by amending Sections 26-20, 26-31, 26-32 and <br /> 26-34 thereof, such amended sections to read as follows: <br /> Section 26-20. Period of membership; Cessation of Membership. <br /> (a) Each employee who becomes a member of the system <br /> shall continue to be a member so long as he remains an employee <br /> and so long thereafter as he is entitled to future benefits <br /> under any provision of the system. Not in limitatioD but in <br /> amplification of the foregoing, the membership of any person in <br /> the system shall cease: <br /> (t) Upon his termination of service as an em- <br /> ployee, other than by retirement, before he has com- <br /> pleted ten years of creditable service, provided, <br /> however, that for purposes of this section the en- <br /> trance of a member into authorized leave of absence <br /> shall not constitute termination of service as an <br /> employee provided the member re-enters service as <br /> an employee at the expiration of the period of au- <br /> thorized leave, and the entrance of a member into <br /> the Armed Forces of the United States shall not con- <br /> stitute termination of service as an employee pro- <br /> vide~ the member's service in such Armed Forces <br /> qualifies as creditable service under Section 26-24; <br /> or <br /> (2) Upon the cessation of his retirement allow- <br /> ance, unless in such event he immediately again be- <br /> comes an employee; or <br /> <br /> (3) Upon his death. <br /> (b) Should any person terminate service as an employee, <br /> other than by retirement under the provisions of this article, <br /> and should such person at any time again become an employee, <br /> whether or not his membership continued, he shall for all purposes <br /> of this article be considered a new employee and a new member, and <br /> any benefits becoming payable under the provisions of this article <br /> <br /> <br />
