AN ORDINANCE TO AMEND THE CODE OF THE CITY OF PORTSMOUTH, VIR- <br />GINIA, 1961, BY A~ENDING C~PTER 18 THEREOF BY ADDING THERETO <br />A NEW S~CT-ON 18-229 1, PERTAINING TO SUSPENSION SYST~IS ON <br />MOTOR VEHICLES. <br /> <br /> W~EREAS, the City of Portsmouth is authorized to <br />enact as ordinances certain statutes from the Code of Virginia, <br />provided such ordinances are substantially consistent with the <br />state law; and <br /> <br /> ~CHEREAS, the General Assembly of Virginia at its <br />1973 session amended certain of those statutes of the Code of <br />Virginia, 1950; and <br /> <br /> YfHEREAS, it is therefore necessary to amend a certain <br />chapter of the Code of the City of Portsmouth~ Virginia, !96tr <br />so as to make said chapter conform to the changes in the Code <br />of Virginia enacted by the General Assembly at its 1973 session. <br /> <br /> NOW, THEREFORE, BE IT O_.DAIN~D by the Council of the <br />City of Portsmouth, Virginia: <br /> <br /> !. That the Code of the City of Portsmouth, Virginia~ <br />1961, be amended by adding thereto a new Section 18-229.1, such <br />new section to read as follows: <br /> <br />Section !8-229.t. <br /> <br />Suspension systems; prohibition of alter- <br />ation thereof; exceptions; penalty for <br />violation. <br /> <br /> (a) No person shall operate a passenger vehicle <br />of a type required to be registered under the laws of the Com- <br />monwealth of Virginia upon a public highway or street of this <br />city modified by reason of alteration of its altitude from the <br />ground if its bumpers, measured to any point on a load bearing <br />member on the horizontal bumper bar~ are not within the range <br />of fourteen lnches to twenty-two inches above the ground~ except <br />t~at no vehicle shall be modified to cause the vehicle body or <br />Chassis to come in contact with the ground or expose the fuel <br />tank to damage from collision or cause the wheels to come in <br />contact with the body under normal operation and that no part <br />of the original suspension system be disconnected to defeat the <br />Safe operation of the suspension system; provided, that nothing <br />COntained in this section shall prevent the installation of heavy <br />duty equipment to include shock absorbers and overload springs; <br />and provided further, that nothing contained in this section <br />shall prevent a person from operating a motor vehicle on a public <br />highway with normal wear of the suspensmon system if normal wear <br />does not affect the control of the vehicle. <br /> <br /> <br />
